SB342,1,3 1An Act to create 40.02 (54w), 40.03 (6) (m) and 40.51 (17) of the statutes;
2relating to: health care coverage for certain state elected and appointed
3officials under plans administered by the Group Insurance Board.
Analysis by the Legislative Reference Bureau
This bill requires the Group Insurance Board to design a separate health care
coverage plan for certain state officials who receive health care coverage under plans
administered by GIB. These officials are the governor, lieutenant governor,
secretary of state, state treasurer, attorney general, state senators, state
representatives to the assembly, and a person who is appointed by the governor to
a position in the executive branch who is the head of a state agency and whose
appointment requires confirmation by the senate. The bill specifies that the benefits
and coverage offered under the new plan may not exceed the minimum benefits or
least amount of coverage of a plan that would be allowable under the federal
American Health Care Act of 2017, the 115th Congress (H.R. 1628). Under the bill,
state officials who are covered under GIB plans must be covered under this new
health care coverage plan.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1Section 1. 40.02 (54w) of the statutes is created to read:
SB342,2,62 40.02 (54w) “State official” means the governor, lieutenant governor, secretary
3of state, state treasurer, attorney general, state senators, state representatives to the
4assembly, and a person who is appointed by the governor to a position in the executive
5branch who is the head of a state agency and whose appointment requires
6confirmation by the senate.
SB342,2 7Section 2. 40.03 (6) (m) of the statutes is created to read:
SB342,2,138 40.03 (6) (m) Shall design a health care coverage plan for state officials who
9receive health care coverage under subch. IV. The benefits and coverage offered
10under the plan may not exceed the minimum benefits or least amount of coverage of
11a health care coverage plan that would be allowable under the federal American
12Health Care Act of 2017, the 115th Congress (H.R. 1628). The plan shall be available
13to state officials who elect coverage under s. 40.51 (6) or 40.52 (1).
SB342,3 14Section 3. 40.51 (17) of the statutes is created to read:
SB342,2,1715 40.51 (17) State officials who receive health care coverage under this
16subchapter must receive health care coverage under the plan designed by the group
17insurance board under s. 40.03 (6) (m).
SB342,4 18Section 4. Initial applicability.
SB342,2,2019 (1) This act first applies to health care coverage plans offered by the group
20insurance board on January 1, 2019.
