AB274,1,2 1An Act to create 84.061 of the statutes; relating to: Department of
2Transportation project cost reduction incentives.
Analysis by the Legislative Reference Bureau
This bill provides that a Department of Transportation contractor may at any
time propose cost reductions to DOT by identifying alternative approaches to
accomplishing the outcomes of the contract. If DOT determines that implementing
cost reductions proposed by a contractor would result in a project of equal or better
quality at a lower cost, DOT must amend the contract to authorize the
implementation of the cost reductions, incorporate the cost savings, and provide 50
percent of the cost savings to the contractor.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB274,1 3Section 1. 84.061 of the statutes is created to read:
AB274,2,3 484.061 Highway project cost reduction incentives. (1) A contractor
5operating under a contract awarded by the department may at any time during
6contract implementation propose cost reductions to the department by identifying
7alternative approaches to satisfying the technical requirements or other outcomes

1identified by the department, including alternative maintenance of traffic,
2alternative pavement sections including subbase, alternative structures and
3drainage, and alternative lines and grades.
AB274,2,8 4(2) If the department determines that implementing cost reductions proposed
5by a contractor would result in a project of equal or better quality at a lower cost, the
6department shall amend the contract to authorize the implementation of the cost
7reductions, incorporate the cost savings, and provide 50 percent of the cost savings
8to the contractor.
