16.304(2)(d) (d) A nonstock corporation organized under ch. 181 that is a nonprofit corporation, as defined in s. 181.0103 (17).

16.305 16.305 Grants to local housing organizations.
16.305(1) (1) The department may make grants to a community-based organization, organization operated for profit, or housing authority to improve the ability of the community-based organization, organization operated for profit, or housing authority to provide housing opportunities, including housing-related counseling services, for persons or families of low or moderate income. The grants may be used to partially defray any of the following:
16.305(1)(a) (a) Salaries, fringe benefits and other expenses associated with personnel of the housing authority, organization operated for profit or community-based organization.
16.305(1)(b) (b) Administrative or operating costs, not described in par. (a).
16.305(2) (2) The department may not make a grant under sub. (1) unless all of the following apply:
16.305(2)(a) (a) The housing authority, organization operated for profit or community-based organization submitted an application for a grant.
16.305(2)(b) (b) The housing authority, organization operated for profit or community-based organization equally matches the grant, by cash or by other assets in kind.
16.305(2)(c) (c) The department determines that the grant to the particular community-based organization, organization operated for profit, or housing authority is appropriate because of any of the following:
16.305(2)(c)1. 1. The quality of the management of the community-based organization, organization operated for profit or housing authority.
16.305(2)(c)2. 2. The amount of other resources for providing housing opportunities that are available to the community-based organization, organization operated for profit or housing authority.
16.305(2)(c)3. 3. The potential impact of the planned activities of the community-based organization, organization operated for profit or housing authority on housing opportunities for persons of low and moderate income in the area.
16.305(2)(c)4. 4. The financial need of the community-based organization, organization operated for profit or housing authority.
16.305(3) (3) A community-based organization, organization operated for profit or housing authority may receive grants under both sub. (1) (a) and (b).
16.305(4) (4) To ensure the development of housing opportunities, the department shall coordinate the use of grants provided under this section with projects undertaken by housing authorities, organizations operated for profit, and community-based organizations.

16.306 16.306 Transitional housing grants.
16.306(1) (1) Definitions. In this section:
16.306(1)(a) (a) "Eligible applicant" means any of the following:
16.306(1)(a)1. 1. A county or municipal governing body.
16.306(1)(a)2. 2. A county or municipal governmental agency.
16.306(1)(a)3. 3. A community action agency under s. 49.265.
16.306(1)(a)4. 4. A private, nonprofit organization.
16.306(1)(a)5. 5. An organization operated for profit.
16.306(1)(b) (b) "Transitional housing" means housing and supportive services for homeless persons that is designed to facilitate the movement of homeless persons to independent living.
16.306(2) (2)
16.306(2)(a)(a) From the appropriation under s. 20.505 (7) (fm), the department may award a grant to an eligible applicant for the purpose of providing transitional housing and associated supportive services to homeless individuals and families if the conditions under par. (b) are satisfied. The department shall ensure that the funds for the grants are reasonably balanced among geographic areas of the state, consistent with the quality of applications submitted.
16.306(2)(b) (b) A recipient of a grant under par. (a) shall agree to use the grant to support a transitional housing program that does all of the following:
16.306(2)(b)1. 1. Utilizes only existing buildings.
16.306(2)(b)2. 2. Utilizes buildings at scattered sites.
16.306(2)(b)3. 3. Facilitates the utilization, by residents, of appropriate social services available in the community.
16.306(2)(b)4. 4. Provides, or facilitates the provision of, training in self-sufficiency to residents.
16.306(2)(b)5. 5. Requires that at least 25% of the income of residents be spent for rent.
16.306(2)(b)6. 6. Permits persons to reside in transitional housing facilities for a period not to exceed 24 months.
16.306(3) (3)Reporting. Each recipient of a grant under this section shall annually provide all of the following information to the department:
16.306(3)(a) (a) The total number of persons served.
16.306(3)(b) (b) The length of stay in transitional housing of each person served.
16.306(3)(c) (c) The housing and employment status of each person served, at the time that the person leaves the transitional housing program.
16.306(3)(d) (d) Any other information that the department determines to be necessary to evaluate the effectiveness of the transitional housing program operated by the recipient.

16.307 16.307 Grants to alleviate homelessness.
16.307(1) (1) Grants. From moneys available under s. 20.505 (7) (h), the department shall make grants to organizations, including organizations operated for profit, that provide shelter or services to homeless individuals or families.
16.307(2) (2)Supplemental funds. The department shall ensure that grants awarded under sub. (1) are not used to supplant other state funds available for homelessness prevention or services to homeless individuals or families.
16.307(2m) (2m)Report. Annually, the department shall submit a report to the speaker of the assembly, the president of the senate and to the appropriate standing committees under s. 13.172 (3) that summarizes how much money was received in the previous year and how that money was distributed.
16.307(3) (3)Rules. The department shall promulgate rules establishing procedures and eligibility criteria for grants under this section.

16.308 16.308 Grants for the provision of shelter for homeless individuals and families.
16.308(1) (1) Definitions. In this section:
16.308(1)(a) (a) "Current operating budget" means the budget for the calendar or fiscal year during which an application is submitted, including all sources and amounts of revenue and all actual and planned expenditures.
16.308(1)(b) (b) "Eligible applicant" means any of the following:
16.308(1)(b)1. 1. A county or municipal governing body.
16.308(1)(b)2. 2. A county or municipal governmental agency.
16.308(1)(b)3. 3. A community action agency.
16.308(1)(b)4. 4. A private nonprofit organization, as defined under s. 108.02 (19), or a nonstock corporation that is organized under ch. 181 and that is a nonprofit corporation, as defined in s. 181.0103 (17).
16.308(1)(b)5. 5. A federally recognized American Indian tribe or band.
16.308(1)(b)6. 6. A housing and community development authority.
16.308(1)(b)7. 7. An organization operated for profit.
16.308(1)(c) (c) "Proposed operating budget" means the budget proposed for the calendar or fiscal year following the year in which an application is submitted, including all anticipated revenue other than the amount sought in the grant application and all planned expenditures.
16.308(1)(d) (d) "Shelter facility" means a temporary place of lodging for homeless individuals or families.
16.308(2) (2)
16.308(2)(a)(a) From the appropriations under s. 20.505 (7) (fm) and (h), the department shall award grants to eligible applicants for the purpose of supplementing the operating budgets of agencies and shelter facilities that have or anticipate a need for additional funding because of the renovation or expansion of an existing shelter facility, the development of an existing building into a shelter facility, the expansion of shelter services for homeless persons, or an inability to obtain adequate funding to continue the provision of an existing level of services.
16.308(2)(b) (b) The department shall allocate funds from the appropriations under s. 20.505 (7) (fm) and (h) for temporary shelter for homeless individuals and families as follows:
16.308(2)(b)1. 1. At least $400,000 in each year to eligible applicants located in Milwaukee County.
16.308(2)(b)2. 2. At least $66,500 in each year to eligible applicants located in Dane County.
16.308(2)(b)3. 3. At least $100,000 in each year to eligible applicants not located in Milwaukee County or Dane County.
16.308(2)(b)4. 4. In addition to the amounts under subds. 1. to 3., no more than $183,500 in each year to eligible applicants without restriction as to the location of the applicants.
16.308(3) (3)Application.
16.308(3)(a)(a) An eligible applicant which is not located in Dane County or Milwaukee County may submit an application for one of the following:
16.308(3)(a)1. 1. A grant of not more than 50% of the current or proposed operating budget of a shelter facility operated by the applicant.
16.308(3)(a)2. 2. A grant of not more than 50% of the portion of the applicant's current or proposed operating budget allocated for providing homeless individuals with vouchers that may be exchanged for temporary shelter.
16.308(3)(am) (am) An eligible applicant located in Dane County or Milwaukee County may submit an application for one of the following:
16.308(3)(am)3. 3. A grant of not more than 50% of the total current or proposed operating budgets of one or more shelter facilities from which the applicant purchases shelter for homeless persons and to which the applicant will distribute the money it receives under conditions described in the application.
16.308(3)(am)4. 4. A grant of not more than 50% of the total current or proposed operating budgets of 2 or more shelter facilities which the applicant represents and to which the applicant will distribute the money received under conditions described in the application.
16.308(3)(b) (b) Applications shall be submitted in the form required by the department and shall be accompanied by the current or proposed operating budget or both, as required by the department, of each shelter facility or agency that will, directly or indirectly, receive any of the grant money, and an explanation of why the shelter facility or agency has or anticipates a need for additional funding.
16.308(3m) (3m)Grant eligibility. In awarding grants under this section, the department shall consider whether the community in which an eligible applicant provides services has a coordinated system of services for homeless individuals and families.
16.308(4) (4)Rule making required. The department shall promulgate by rule both of the following:
16.308(4)(a) (a) Criteria for awarding grants.
16.308(4)(b) (b) Criteria for determining whether an agency that operates a shelter facility or program is eligible for a grant.
16.308(5) (5)Prohibited uses. The department may not provide a grant for any of the following purposes:
16.308(5)(a) (a) The construction of a new shelter facility.
