SENATE AMENDMENT 2, TO SENATE BILL 8

SB8-SA2,1,1 At the locations indicated, amend the bill as follows:

SB8-SA2,1,3 1. Page 3, line 21: delete the material beginning with that line and ending with page 4, line 2, and substitute:

SB8-SA2,1,5 “(f) “Unsuccessful attempt to repair” means a repair attempt that does not correct the nonconformity for which the repair work is conducted.”.

SB8-SA2,1,7 2. Page 4, line 14: delete “days,” and substitute “days for factors that are within the manufacturer’s control,”.

SB8-SA2,1,9 3. Page 4, line 20: delete “costs.” and substitute “costs, less a reasonable allowance for use.”.

SB8-SA2,1,10 4. Page 5, line 9: delete lines 9 to 18 and substitute:

SB8-SA2,2,4 “(4) A consumer who elects to receive a refund under sub. (3) shall notify the manufacturer in writing. Not later than 30 days after receiving written notice from the consumer, the manufacturer shall provide the consumer with the refund. Upon receipt of the refund, the consumer shall return the implement of husbandry having the nonconformity to the manufacturer.”.

SB8-SA2,2,6 5. Page 6, line 4: after “husbandry” insert “that is valued at $100,000 or more and that was”.

SB8-SA2,2,7 6. Page 6, line 20: after that line insert:

SB8-SA2,2,8 “Section 9m. Initial applicability.

SB8-SA2,2,10 (1) This act first applies to an implement of husbandry that is delivered to a consumer on the effective date of this subsection.

SB8-SA2,10m Section 10m. Effective date.

SB8-SA2,2,13 (1) This act takes effect on the first January 1 that occurs at least one year after publication.”.
