This amended Statement of Scope replaces the
Statement of Scope submitted to the Governor on August 5, 2015
1. Finding/nature of emergency (Emergency Rule only):
Not required per 2015 Wisconsin Act 49, Section 5, Nonstatutory provisions.
2. Detailed description of the objective of the proposed rule:
The objective of the proposed rule is to establish standards for the construction and inspection of camping units set in a fixed location in a permitted campground. These camping units will contain a sleeping place for seasonal overnight camping. The rule intends to establish general requirements plus electrical and plumbing standards specific to the camping units.
3. Description of the existing policies relevant to the rule, new policies proposed to be included in the rule, and an analysis of policy alternatives:
There are currently no existing rules for this type of overnight accommodation. Campgrounds have camping sites for RVs, campers or tents, but any structure for camping which has electrical or plumbing facilities other than a licensed RV has to meet the Uniform Dwelling Code. 2015 Act 49 mandated that the Department develop rules for construction and inspection of camping units including rules for installing and maintaining their electrical and plumbing systems.
The alternative would be to not develop rules for this type of camping unit, which would put the Department in non-compliance with the statutes.
4. Detailed explanation of statutory authority for the rule (including the statutory citation and language):
Section 227.11 (2) (a) of the Statutes authorizes the Department to promulgate rules interpreting any statute that is enforced or administered by the Department, if the rule is considered necessary to effectuate the purpose of the statute.
Section 101.63 (1) requires the Department to establish separate standards for the construction of one- and two-family dwellings, including camping cabins used for seasonal overnight camping.
Section 101.82 (1) requires the Department to promulgate rules that establish standards for installing, repairing, and maintaining electrical wiring for camping units.
Section 145.02 (2) (b) requires the Department to promulgate rules that establish plumbing standards applicable only to camping units.
5. Estimate of amount of time that state employees will spend developing the rule and of other resources necessary to develop the rule:
300 hours.
6. List with description of all entities that may be affected by the proposed rule:
Campers, campground owners, lodging businesses, small contractors, construction material suppliers, and building inspectors may be affected by the rule.
7. Summary and preliminary comparison with any existing or proposed federal regulation that is intended to address the activities to be regulated by the proposed rule:
No corresponding proposed federal regulations were found.
8. Anticipated economic impact of implementing the rule (note if the rule is likely to have a significant economic impact on small businesses):
The rule changes contemplated in this project are not expected to have a significant negative economic impact on any of the entities listed above.
