Rule Submittal Date
On October 30, 2018, the Wisconsin Department of Revenue submitted a proposed rule to the Wisconsin Legislative Council Rules Clearinghouse.
The scope statement for this rule, SS 079-18, was approved by the Governor on July 5, 2018, published in Register No. 751A2 on July 9, 2018, and approved by the Secretary of Revenue on July 31, 2018.
The objective of the rule is to amend guidance for out-of-state retailers without a physical presence in Wisconsin that make Wisconsin sales. The new guidance will be consistent with limits expressed in the Wayfair decision. Wisconsin began its enforcement on October 1, 2018.
Agency Procedure for Promulgation
A public hearing on the proposed rule is required and will be scheduled.
The Office of the Secretary is primarily responsible for the promulgation of the proposed rule.
