Re: Petition for Authorization to Repeal Rule Ins 8.01 to 8.09, Wis. Adm. Code
Dear Senator Nass and Representative Ballweg:
I am petitioning for authorization to repeal ss. Ins 8.01 to 8.09, Wis. Adm. Code, relating to employee welfare plans. A copy of the proposed rule is attached. The agency lacks authority to administer the rules under ss. Ins. 8.01 to 8.09, Wis. Adm. Code, as the statute cited in the code provision references a statute, ch. 641, Stats., that was repealed by 2003 Wis. Act 261 and not replaced. Sections Ins. 8.01 to 8.09, Wis. Adm. Code, addressed definitions and requirements for employee welfare plans implementing ch. 641, Stats., as created by Chapter 339, laws of 1977. Therefore, I request authorization to repeal this rule by utilizing the expedited process under s. 227.26(4), Wis. Stat. Sincerely,
