Dear Senator Nass, Representative Ballweg, and Secretary Cole:
On April 19, 2019, the Department of Natural Resources submitted a petition to repeal ch. NR 546, Wis. Adm. Code to Sen. Nass and Rep. Ballweg, the co-chairpersons of the Joint Committee for Review of Administrative Rules. In the petition, the department indicated that statutory authority for ch. NR 546 was repealed by 2017 Wis. Act 7, and the current version of ch. NR 546 published by the LRB indicates as such. However, authority for ch. NR 546 was in fact repealed by 2015 Wis. Act 7, not 2017 Wis. Act 7. I wanted to inform you of this as you consider this petition. We apologize for the error and will issue a corrected copy of ch. NR 546 in this Monday’s register. Thank you.
