PETITION OF THE STATE OF WISCONSIN DEPARTMENT OF NATURAL RESOURCES

REPEALING AN UNAUTHORIZED RULE

The Wisconsin Department of Natural Resources proposes the following permanent rule to repeal NR 186, relating to the solid waste management grant program.

3. Explanation of Agency Authority:

  Statutory authority for ch. NR 186, Wis. Adm. Code, was repealed by 2011 Wis. Act 32.

4. Related Statutes or Rules:

  Chapter NR 185, Wis. Adm. Code, is obsolete and will be addressed by a future rulemaking   effort. It references an outdated statute requiring area-side solid waste management plans.

5. Plain Language Analysis:

Chapter NR 186, Wis. Adm. Code, establishes grant procedures for financial assistance in developing area-wide solid waste management plans by local units of government. The statutory requirement for area-wide solid waste management plans and associated grant funding was repealed by 2011 Wis. Act 32.

TEXT OF RULE

Section 1   NR 186 is repealed.

Section 2. Effective Date. This rule takes effect on the first day of the month following publication in the Wisconsin Administrative Register as provided in s. 227.22 (2) (intro.), Stats.
