Notice of Hearing
The Department of Natural Resources announces that it will hold a public hearing on a permanent rule to revise chs. NR 300, 301, 305 and 310, relating to administration, procedures and enforcement of the Wisconsin Wetland and Waterway regulatory program, at the time and place shown below.
Hearing Information
Date:   March 7, 2022
Time:   1-3pm
Rule Information:
Current chs. NR 300, 301, 305, and 310 have outdated language and are missing administrative and procedural steps for Waterways Program activities. This rule would establish procedures, timelines, and fees for permitting, exemptions, and other regulatory determinations in the Program. The department would align administrative procedures with current statutes and process language redundant with statute would be repealed. This rule also proposes to adjust fees to reflect costs incurred by the Wisconsin Department of Natural Resources to conduct permit reviews consisent with ch. 30 and s. 281.36, Wis. Stat.
Accessibility:
For the hearing or visually impaired, non-English speakers, or those with other personal circumstances which might make communication at the meeting/hearing difficult, DNR will, to the maximum extent possible and with reasonable advance notice, provide aids including an interpreter, or a non-English, large-print, or recorded version of hearing documents. Written comments and any questions on the proposed rules should be submitted to:
Department of Natural Resources
Attn: Amanda Minks
P.O. Box 7921
101 S. Webster Street,
Madison, WI 53707-7921
The rule may be reviewed, and comments made at: http://docs.legis.wisconsin.gov/code/chr/hearings.
Initial Regulatory Flexibility Analysis:
The revised rule is not likely to have a significant economic impact on small businesses. The Department believes the economic impact would be minimal to moderate because the regulatory changes are minor and seek to clarify the Department's current implementation practices. No mandatory fees will be created through this rule making effort although some additional services may be offered within the existing regulatory scope of ch. 30, 23.321 and s. 281.36, Wis. Stats.
