2001 WISCONSIN ACT 48
An Act to amend 15.373 (2), 35.81 (1), 43.01 (2), 115.43 (1) and 121.845 (2) of the statutes; relating to: the name of the division for libraries and community learning in the department of public instruction and the definition of minority group (suggested as remedial legislation by the department of public instruction).
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
Law revision committee prefatory note: This bill is a remedial legislation proposal, requested by the department of public instruction and introduced by the law revision committee under s. 13.83 (1) (c) 4., stats. After careful consideration of the various provisions of the bill, the law revision committee has determined that this bill makes minor substantive changes in the statutes, and that these changes are desirable as a matter of public policy.
48,1 Section 1. 15.373 (2) of the statutes is amended to read:
15.373 (2) Division for libraries, technology, and community learning. There is created in the department of public instruction a division for libraries, technology, and community learning.
Note: Sections 1, 2 and 3 of this bill change the name of the "Division for Libraries and Community Learning" to the "Division for Libraries, Technology, and Community Learning." According to the department of public instruction, the name of its "Libraries and Community Learning Division" was changed to the "Division for Libraries, Technology and Community Learning" in 1998.
48,2 Section 2. 35.81 (1) of the statutes is amended to read:
35.81 (1) "Division" means the division for libraries, technology, and community learning in the department of public instruction.
48,3 Section 3. 43.01 (2) of the statutes is amended to read:
43.01 (2) "Division" means the division for libraries, technology, and community learning in the department.
48,4 Section 4. 115.43 (1) of the statutes is amended to read:
115.43 (1) Definition. In this section, "minority group pupil" means a pupil who is a Black or African American, an Hispanic, American Indian, a spanish surnamed American or an Oriental American an Alaskan native, or a person of Asian or Pacific Island origin.
Note: Sections 4 and 5 of this bill change the definition of "minority group pupil" in the minority group pupil scholarship program and special transfer program from "a pupil who is a Black American, a native American, a Spanish-surnamed American or an Oriental American to "a pupil who is Black or African American, Hispanic, American Indian, an Alaskan native or a person of Asian or Pacific Island origin." According to the department of public instruction, the current definition of "minority pupil" is not consistent with the federal definition of race and ethnicity categories, and excludes individuals that may be identified as minority students.
48,5 Section 5. 121.845 (2) of the statutes is amended to read:
121.845 (2) "Minority group pupil" means a pupil who is a Black or African American, a native Hispanic, American, a Spanish-surnamed American or an Oriental American Indian, an Alaskan native, or a person of Asian or Pacific Island origin, and who has reached the age of 4 on or before September 1 of the year he or she enters school.
