AB134-ASA1,1,2 1An Act to amend 895.035 (4m); and to create 895.035 (2g) of the statutes;
2relating to: ordinance violations regarding graffiti.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB134-ASA1, s. 1 3Section 1. 895.035 (2g) of the statutes is created to read:
AB134-ASA1,1,94 895.035 (2g) The parent or parents with custody of a minor child are liable for
5the cost of the repair or replacement of, or the removal of the etching, marking,
6drawing or writing from, property damaged as the result of a violation of an
7ordinance that prohibits intentional etching or marking, drawing or writing with
8paint, ink or other substance on the physical property of another without the other's
9consent.
AB134-ASA1, s. 2 10Section 2. 895.035 (4m) of the statutes, as created by 1995 Wisconsin Act 24,
11is amended to read:
AB134-ASA1,2,612 895.035 (4m) The maximum recovery from any parent or parents may not
13exceed $4,000 for damages resulting from any one act regarding a violation under of
14a minor child who violates an ordinance that prohibits intentional etching or

1marking, drawing or writing with paint, ink or other substance on the physical
2property of another without the other's consent or who violates
s. 943.017 of a child,
3in addition to taxable costs and disbursements and reasonable attorney fees, as
4determined by the court. If 2 or more children in the custody of the same parent or
5parents commit the same act the total recovery may not exceed $4,000, in addition
6to taxable costs and disbursements.
AB134-ASA1, s. 3 7Section 3. Initial applicability.
AB134-ASA1,2,9 8(1)  This act first applies to violations committed on the effective date of this
9subsection.
