AB150-ASA1-AA26,452,11 (a) Creation; duties.

AB150-ASA1-AA26,452,12 1. In this subsection:

AB150-ASA1-AA26,452,14 a.  "Commission" means the commission on privatization created under subdivision 2.

AB150-ASA1-AA26,452,15 b.  "State agency" has the meaning given in section 20.001 (1) of the statutes.

AB150-ASA1-AA26,452,17 2. There is created a special committee to be called the commission on privatization consisting of the following:

AB150-ASA1-AA26,452,18 (a) The governor or his or her designee.

AB150-ASA1-AA26,452,19 1.  The secretary of administration or his or her designee.

AB150-ASA1-AA26,452,22 a.  Two senators and 2 representatives to the assembly, representing the majority and minority parties in each house, appointed in the same manner as members of standing committees.

AB150-ASA1-AA26,452,24 b.  One employe of the department of administration designated by the secretary of administration to serve as the nonvoting secretary of the commission.

AB150-ASA1-AA26,453,6 c.  Nine members appointed by the governor who are not public officers or employes. In making these appointments, the governor shall include one or more business owners and managers, employes who are not owners or managers, representatives of labor organizations, and theoreticians or consultants in the fields of business organization or management, personnel management or employment relations.

AB150-ASA1-AA26,453,8 3. All members of the commission shall be designated or appointed within 10 days after the effective date of this subdivision.

AB150-ASA1-AA26,453,17 4. The governor shall designate one of the members of the commission to serve as the chairperson of the commission and shall call the first meeting of the commission. At the first meeting, the commission shall select 2 vice chairpersons. The commission shall hold meetings at the call of the chairperson or upon the written request of 5 members of the commission. A majority of the members of the commission who are entitled to vote constitutes a quorum to do business. Each member of the commission shall serve without compensation for his or her services, but shall be reimbursed for his or her actual and necessary expenses incurred in the performance of his or her duties.

AB150-ASA1-AA26,453,21 5. The commission may accept gifts, grants, bequests and devises that are made to fund the expenses of the commission. All moneys received under this paragraph shall be credited to the appropriation account under section 20.505 (3) (gb) of the statutes, as created by this act.

AB150-ASA1-AA26,453,24 6.  a.  The commission shall study and evaluate all functions of state government that may be delegated to the private sector at a cost savings to state taxpayers.

AB150-ASA1-AA26,454,2 b.  The commission may appoint subcommittees, which may be assigned by the commission to develop recommendations for inclusion in specific reports.

AB150-ASA1-AA26,454,4 c.  The commission shall submit reports of its findings and any recommendations to the competitive enterprise review board, as created by this act.

AB150-ASA1-AA26,454,8 d.  The commission may propose legislation to carry out its recommendations by submitting its legislative proposals to the competitive enterprise review board, as created by this act. The commission may hold public hearings on its legislative proposals.

AB150-ASA1-AA26,454,12 7.  The commission may call upon any state agency to make available the resources, facilities or data of the state agency for use by the commission. Each state agency shall cooperate with the commission to the fullest extent possible, including the provision, if requested by the commission, of staff assistance.

AB150-ASA1-AA26,454,16 8. The commission shall submit its reports under subdivision 6. c. and all of its legislative proposals under subdivision 6. d. no later than the first day of the 7th month beginning after the effective date of this subsection. Upon submittal of its reports, the commission ceases to exist.

AB150-ASA1-AA26, s. 9201 Section 9201. Appropriation changes; administration.

AB150-ASA1-AA26,455,2 (1)  Funding of commission on privatization. If the moneys appropriated under section 20.505 (3) (a) of the statues are not sufficient to fund the operation of the commission on privatization, as created by this act, in conformity with the budget for the commission approved by the joint committee on finance under section 16.40 (14) of the statutes the secretary of administration shall transfer sufficient moneys from the appropriation account under section 20.505 (1) (a) of the statues to the appropriation account under section 20.505 (3) (a) of the statues to provide for the operation of the commission. Upon such transfer, the amount in the schedule for the appropriation under section 20.505 (3) (a) of the statutes is increased by the amount transferred during the fiscal year for which the transfer is made.".

AB150-ASA1-AA26,455,6 (a)  In this subsection, "executive branch agency" has the meaning given in section 16.70 (4) of the statutes.

AB150-ASA1-AA26,455,15 (b)  No later than January 1, 1996, each executive branch agency shall submit to the secretary of administration a report which describes the documents and other materials published by the agency and the mailings by the agency of substantially similar materials in bulk quantities. The report shall address the appropriateness and feasibility of securing sponsorship for such documents, materials and mailings, if the agency were authorized by law to do so, including specific types of sponsorship for specific documents, materials and mailings. An executive branch agency may conduct such surveys as may be required to obtain necessary data for the report prepared by the agency.

AB150-ASA1-AA26,455,20 (c) The secretary of administration shall examine the reports received under paragraph (b) and shall report to the legislature in the manner prescribed under section 13.172 (2) of the statutes, concerning any legislative proposals that may be required to implement recommendations of the secretary concerning sponsorship for documents, materials or mailings of executive branch agencies.".

In each fiscal year in the 1995-97 fiscal biennium, the secretary shall ensure that no executive branch agency fills a number of full-time equivalent positions that become vacant exceeding 75% of the total full-time equivalent positions for that agency identified under this paragraph for the preceding fiscal year. Notwithstanding section 16.50 (1) (a) of the statutes, the secretary shall require each executive branch agency to submit expenditure estimates for the filling of all vacant full-time equivalent positions during the 1995-97 fiscal biennium and shall withhold approval of any expenditure estimate for the filling of a position that is inconsistent with this subsection.".
