SENATE AMENDMENT 29, To 1995 ASSEMBLY BILL 21

AB21-SA29,1,1 At the locations indicated, amend the bill as follows:

AB21-SA29,1,4 1. Page 5, line 9: delete lines 9 to 11 and substitute: "the department. Paragraphs (b) to (d) apply only while a waiver under this paragraph is in effect and only with respect to recipients covered by the waiver.

AB21-SA29,1,5 (am) Notwithstanding par. (a), the department may not do any of the following:

AB21-SA29,1,6 1. Apply the waiver to any person who is subject to s. 49.25.

AB21-SA29,1,10 2. Operate the demonstration project if the legislative audit bureau has made a determination under 1995 Wisconsin Act .... (this act), section 12 (7), that, for 1997, the abortion rate for women who are subject to the waiver under par. (a) exceeds the statewide average abortion rate for women of child-bearing age.".

AB21-SA29,1,12 " Section 11m. 69.186 (1) (gm) of the statutes is created to read:

AB21-SA29,1,16 69.186 (1) (gm) For induced abortions performed in 1997, information that the department determines necessary, after consultation with the legislative audit bureau, to determine whether the patient is subject to the waiver under s. 49.19 (11s).".

AB21-SA29,2,1 3. Page 12, line 10: after that line insert:

AB21-SA29,2,15 "(7) Legislative audit bureau study. The legislative audit bureau shall conduct a study to determine whether, in 1997, the abortion rate for women who are subject to the waiver under section 49.19 (11s) (a) of the statutes exceeds the statewide average abortion rate for women of child-bearing age. In this subsection, the "abortion rate for women who are subject to par. (a)" shall mean the number of induced abortions performed for women who are of child-bearing age and who are subject to section 49.19 (11s) (a) of the statutes divided by the number of women who are of child-bearing age and who are subject to section 49.19 (11s) (a) of the statutes. In this subsection, the "statewide average abortion rate for women of child-bearing age" shall mean the number of induced abortions performed for all women in the state divided by the number of women in the state of child-bearing age. The legislative audit bureau shall submit the results of its study to the department of health and social services and to the legislature in the manner provided for under section 13.172 (3) of the statutes no later than April 1, 1998.".
