(am) Notwithstanding par. (a), the department may not do any of the following:

1. Apply the waiver to any person who is subject to s. 49.25.

9the abortion rate for women who are subject to the waiver under par. (a) exceeds the

(1) (gm) For induced abortions performed in 1997, information that the
14department determines necessary, after consultation with the legislative audit
15bureau, to determine whether the patient is subject to the waiver under s. 49.19

(7) Legislative audit bureau study. The legislative audit bureau shall
3conduct a study to determine whether, in 1997, the abortion rate for women who are
4subject to the waiver under section 49.19 (11s) (a) of the statutes exceeds the
5statewide average abortion rate for women of child-bearing age. In this subsection,
6the "abortion rate for women who are subject to par. (a)" shall mean the number of
7induced abortions performed for women who are of child-bearing age and who are
8subject to section 49.19 (11s) (a) of the statutes divided by the number of women who
9are of child-bearing age and who are subject to section 49.19 (11s) (a) of the statutes.
10In this subsection, the "statewide average abortion rate for women of child-bearing
11age" shall mean the number of induced abortions performed for all women in the
12state divided by the number of women in the state of child-bearing age. The
13legislative audit bureau shall submit the results of its study to the department of
14health and social services and to the legislature in the manner provided for under
15section 13.172 (3) of the statutes no later than April 1, 1998.".
