ASSEMBLY AMENDMENT 4, To 1995 ASSEMBLY BILL 293

AB293-AA4,1,1 At the locations indicated, amend the bill as follows:

AB293-AA4,1,6 1. Page 3, line 13: delete lines 13 to 15 and substitute: "person is prohibited from possessing a firearm under s. 51.20 (13) (cv), a search to determine whether the person is subject to an injunction under s. 813.12 or 813.122 or a tribal injunction filed with the circuit court under s. 813.12 (9) (a), and a search to determine whether the person is prohibited from possessing a firearm under s. 813.125 (4m).".

AB293-AA4,1,7 2. Page 10, line 22: delete lines 22 and 23 and substitute:

AB293-AA4,1,13 "813.125 (4m) Restriction on firearm possession; surrender of firearms. (a) If a judge or court commissioner issues an injunction under sub. (4) and the judge or court commissioner determines, based on evidence presented at the hearing on the issuance of the injunction, that the respondent may use a firearm to cause physical harm to another or to endanger public safety, the judge or court commissioner may prohibit the respondent from possessing a firearm.

AB293-AA4,1,15 (b) An order prohibiting a respondent from possessing a firearm issued under par. (a) remains in effect until the expiration of the injunction issued under sub. (4).

AB293-AA4,2,2 (c) An order issued under par. (a) that prohibits a respondent from possessing a firearm shall do all of the following:".

AB293-AA4,2,3 3. Page 11, line 9: substitute "(d)" for "(b)"; and substitute "(c)" for "(a)".

AB293-AA4,2,4 4. Page 11, line 16: substitute "(e)" for "(c)"; and substitute "(c)" for "(a)".

AB293-AA4,2,5 5. Page 12, line 1: delete lines 1 to 4 and substitute:

AB293-AA4,2,11 "813.125 (5r) Notice to department of justice. If an order prohibiting a respondent from possessing a firearm is issued under sub. (4m), the clerk of the circuit court shall notify the department of justice of the existence of the order prohibiting a respondent from possessing a firearm and shall provide the department of justice with information concerning the period during which the order is in effect and information neces-".

AB293-AA4,2,13 6. Page 12, line 8: delete "s. 813.12, 813.122 or" and substitute "s. 813.12 or 813.122".

AB293-AA4,2,14 7. Page 12, line 9: delete "813.125".

AB293-AA4,2,15 8. Page 12, line 10: before that line insert:

AB293-AA4,2,16 " Section 23g. 941.29 (1) (g) of the statutes is created to read:

AB293-AA4,2,17 941.29 (1) (g) Ordered not to possess a firearm under s. 813.125 (4m).".

AB293-AA4,2,18 9. Page 12, line 23: after "(e)" insert "or (g)".
