1An Act to renumber and amend 95.69 (1) (c);
to amend 95.68 (2); and
to create
295.68 (2m), 95.69 (1) (c) 3. and 95.69 (8m) of the statutes;
relating to:
3exempting certain auctioneers from the requirement to obtain a livestock
4dealer license and exempting certain persons from the requirement to obtain
5a livestock market license.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

(2) License. No
Except as provided in sub. (2m), no person may operate
8a livestock market without an annual license from the department. A livestock
9market license expires on June 30 annually. A separate license is required for every
10livestock market. A license is not transferable between persons or locations.

(2m) Exception. A person is not required to obtain a license under sub.
13(2) to operate an occasional auction sale sponsored by a livestock breeder association
1if records of the transactions at the sale are maintained by an auctioneer registered
2under ch. 480 or by a livestock dealer licensed under s. 95.69.

3. 95.69 (1) (c) of the statutes is renumbered 95.69 (1) (c) (intro.) and
4amended to read:

(1) (c) (intro.) "Livestock dealer" means a person who, as principal or
6agent, engages in the business of buying for resale or for slaughter, selling or
7exchanging livestock. "Livestock dealer" does not include

92. The operator of a farm who sells livestock if the operator keeps them on the
10farm solely for dairy, breeding or feeding purposes and the operator is not otherwise

4. 95.69 (1) (c) 3. of the statutes is created to read:

(8m) Transaction records. An auctioneer registered under ch. 480 who
20sells livestock and who is not required to obtain a license under this section shall
21make records of the sales available to the department upon request for disease
22investigation purposes.
