AB469-ASA1,1,6 1An Act to renumber and amend 343.50 (6); to amend 343.20 (2m); and to
2create
20.395 (5) (cj), 110.08 (1m), 343.01 (2) (dg), 343.14 (2) (gm), 343.175 (1r),
3343.175 (4), 343.21 (2) (c) and 343.50 (6) (b) of the statutes; relating to: driver's
4licenses and identification cards issued by the department of transportation,
5anatomical donations, organ donor educational programs and making an
6appropriation.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB469-ASA1, s. 1 7Section 1. 20.395 (5) (cj) of the statutes is created to read:
AB469-ASA1,1,108 20.395 (5) (cj) Driver licensing, organ donor education, state funds. From the
9general fund, all moneys received from fees under ss. 343.21 (2) (c) and 343.50 (6) (b)
10for the purpose of organ donor educational programs under s. 343.175 (4).
AB469-ASA1, s. 2 11Section 2. 110.08 (1m) of the statutes is created to read:
AB469-ASA1,2,412 110.08 (1m) Each operator's license examiner shall receive informational
13training on the powers and duties of the department relating to organ donor
14information under s. 343.175 once every 2 years and, for operator's license examiners

1hired after the effective date of this subsection .... [revisor inserts date], prior to
2initial assignment to operator's license examining activities. The informational
3training under this subsection shall be developed by all organ procurement
4organizations, as defined in s. 343.01 (2) (dg), in cooperation with the department.
AB469-ASA1, s. 3 5Section 3. 343.01 (2) (dg) of the statutes is created to read:
AB469-ASA1,2,86 343.01 (2) (dg) "Organ procurement organization" means an organization that
7has status as a designated organ procurement organization under the requirements
8of 42 CFR 485.303.
AB469-ASA1, s. 4 9Section 4. 343.14 (2) (gm) of the statutes is created to read:
AB469-ASA1,2,1210 343.14 (2) (gm) If the application is for renewal of a license or identification
11card, a place for the applicant to designate an additional payment of $1 for costs
12associated with organ donor information under s. 343.175.
AB469-ASA1, s. 5 13Section 5. 343.175 (1r) of the statutes is created to read:
AB469-ASA1,2,2414 343.175 (1r) Department to provide information. In addition to the inquiry
15under sub. (1), if the applicant is at least 18 years of age, the department shall orally
16state to the applicant that he or she has the opportunity to indicate his or her
17willingness to be an organ donor. If the applicant indicates that he or she is
18undecided in response to the inquiry under sub. (1), the department shall provide the
19applicant with written information that all organ procurement organizations and
20the department have together developed. If the applicant makes an affirmative
21response to the inquiry under sub. (1), the department shall request at that time that
22the applicant write on the license the information that is specified under sub. (2) (ar)
23and affix a sticker, as described in sub. (3) (a), to the front side of the license
24document.
AB469-ASA1, s. 6 25Section 6. 343.175 (4) of the statutes is created to read:

1343.175 (4) Organ donor educational programs. From the appropriation
2under s. 20.395 (5) (cj), the department shall annually distribute funds for organ
3donor educational programs to an organ procurement organization, under a funding
4formula consisting of an identical amount for each organ procurement organization.
5In order to ensure compliance with this subsection, the department shall require a
6financial report of expenditures under this subsection from each organ procurement
7organization.
AB469-ASA1, s. 7 8Section 7. 343.20 (2m) of the statutes is amended to read:
AB469-ASA1,3,159 343.20 (2m) The department shall include with the notice that it mails under
10sub. (2) information regarding the requirements of s. 347.48 (4); information, as
11developed by all organ procurement organizations in cooperation with the
12department, that promotes anatomical donations and which relates to the
13anatomical donation opportunity available under s. 343.175;
and, for licensees aged
1465 years or older, material, as provided by the department, explaining the voluntary
15program that is specified in s. 71.55 (10) (b).
AB469-ASA1, s. 8 16Section 8. 343.21 (2) (c) of the statutes is created to read:
AB469-ASA1,3,2317 343.21 (2) (c) In addition to the fees set under sub. (1), an applicant for a
18renewal license who has made a designation for an additional payment under s.
19343.14 (2) (gm) shall pay to the department an additional fee of $1. All moneys
20received under this paragraph in excess of the costs associated with the powers and
21duties of the department relating to organ donor information under s. 343.175 shall
22be deposited in the general fund and credited to the appropriation under s. 20.395
23(5) (cj).
AB469-ASA1, s. 9 24Section 9. 343.50 (6) of the statutes is renumbered 343.50 (6) (a) and amended
25to read:

1343.50 (6) (a) At least 30 days prior to the expiration of the card, the
2department shall mail a renewal application to the last-known address of each
3identification card holder. The department shall include with the application
4information, as developed by all organ procurement organizations in cooperation
5with the department, that promotes anatomical donations and which relates to the
6anatomical donation opportunity available under s. 343.175.
The fee for a renewal
7identification card shall be $4, which card shall be valid for 4 years.
AB469-ASA1, s. 10 8Section 10. 343.50 (6) (b) of the statutes is created to read:
AB469-ASA1,4,159 343.50 (6) (b) In addition to the fee for renewal of an identification card under
10par. (a), an applicant who has made a designation for an additional payment as
11provided under s. 343.14 (2) (gm) shall pay to the department an additional fee of $1.
12All moneys received under this paragraph in excess of the costs associated with the
13powers and duties of the department relating to organ donor information under s.
14343.175 shall be deposited in the general fund and credited to the appropriation
15under s. 20.395 (5) (cj).

AB469-ASA1,4,18 17(1)This act takes effect on the first day of the 6th month beginning after
18publication.
