AB604-ASA1,1,4 1An Act to amend 303.21 (1) (b); to repeal and recreate 303.21 (1) (b); and to
2create
303.063 of the statutes; relating to: authorizing the department of
3corrections to establish a secure work program, granting rule-making
4authority and making an appropriation.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB604-ASA1, s. 1 5Section 1. 303.063 of the statutes is created to read:
AB604-ASA1,1,8 6303.063 Secure work program. (1) The department may establish a secure
7work program for inmates in which inmates are assigned to work away from the
8grounds of the institution while appropriately restrained for security purposes.
AB604-ASA1,1,11 9(2) If the department establishes a secure work program under sub. (1), the
10department shall, before implementing the program, promulgate rules specifying
11the procedures and regulations relating to the program.
AB604-ASA1, s. 2 12Section 2. 303.21 (1) (b) of the statutes, as affected by 1995 Wisconsin Act 27,
13section 6400, is amended to read:

1303.21 (1) (b) Inmates are included under par. (a) if they are participating in
2a structured work program away from the institution grounds under s. 302.15 or a
3secure work program under s. 303.063
. Inmates are not included under par. (a) if
4they are employed in a prison industry under s. 303.06 (2), participating in a work
5release program under s. 303.065 (2), participating in employment with a private
6business under s. 303.01 (2) (em) or participating in the transitional employment
7program, but they are eligible for worker's compensation benefits as provided under
8ch. 102.
AB604-ASA1, s. 3 9Section 3. 303.21 (1) (b) of the statutes, as affected by 1995 Wisconsin Acts 27,
10section 6401, and .... (this act), is repealed and recreated to read:

13secure work program under s. 303.063. Inmates are not included under par. (a) if
14they are employed in a prison industry under s. 303.06 (2), participating in a work
15release program under s. 303.065 (2), participating in employment with a private
16business under s. 303.01 (2) (em) or participating in the transitional employment
17program, but they are eligible for worker's compensation benefits under ch. 102.
18Residents subject to s. 303.01 (1) (b) are not included under par. (a) but they are
19eligible for worker's compensation benefits under ch. 102.
AB604-ASA1, s. 4 20Section 4. Appropriation changes.
AB604-ASA1,3,2 21(1) In the schedule under section 20.005 (3) of the statutes for the
22appropriation to the department of corrections under section 20.410 (1) (a) of the
23statutes, as affected by the acts of 1995, the dollar amount is increased by $183,800
24for fiscal year 1996-97 to increase the authorized FTE positions for the department

1by 4.0 GPR positions for the performance of duties relating to a secure work program
2for inmates.
AB604-ASA1, s. 5 3Section 5. Effective dates. This act takes effect on the day after
4publication, except as follows:
AB604-ASA1,3,6 5(1) The repeal and recreation of section 303.21 (1) (b) of the statutes takes effect
6on January 1, 1996, or on the day after publication, whichever is later.
