AB722-ASA2,1,2 An Act to repeal 13.83 (4); and to create 13.83 (4) of the statutes; relating to: creating an environmental science study committee.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB722-ASA2, s. 1 Section 1. 13.83 (4) of the statutes is created to read:

AB722-ASA2,1,9 13.83 (4) Environmental science study committee. (a) In this subsection, "agency" means any office, department, agency, institution of higher education, association, society or other body in state government created or authorized to be created by the constitution or any law which is entitled to expend moneys appropriated by law, including the legislature and the courts, and any authority created under ch. 231 or 234.

AB722-ASA2,2,2 (b) The joint legislative council shall in each biennium create an environmental science study committee. The committee shall consist of 9 members, appointed by the joint legislative council, who are not legislators and who have demonstrated expertise in at least one of the following: the engineering sciences, economic sciences, biological sciences, physical sciences, human medical sciences or statistical or risk assessment sciences. The members shall be appointed for 3-year terms.

AB722-ASA2,2,3 (c) The committee may do any of the following:

AB722-ASA2,2,5 1. Advise any agency on issues affecting the protection and management of the environment and natural resources in this state.

AB722-ASA2,2,7 2. Evaluate proposed rules that establish environmental or natural resources standards or other criteria.

AB722-ASA2,2,9 3. Review the scientific and technical adequacy of environmental programs, guidelines, methodologies, protocols and tests.

AB722-ASA2,2,11 4. Recommend any scientific standard or other criteria for protection of human health and the environment that the committee determines is appropriate.

AB722-ASA2,2,14 5. Review new information needs, the adequacy of data collection and analysis and the quality of agency environmental plans or programs of research, development and demonstration.

AB722-ASA2,2,15 6. Assess the importance of natural and anthropogenic sources of pollution.

AB722-ASA2,2,19 (d) In performing any function under par. (c), the committee shall consult and work closely with agencies, shall use sound, objective and scientific reasoning, shall assess the relative risk to human health and the environment and shall consider economic consequences.

AB722-ASA2,3,3 (e) The committee may create any subcommittee necessary to carry out any of the committee's functions under par. (c). If the committee creates a subcommittee under this paragraph, the committee shall appoint members to the subcommittee who have the scientific and technical expertise to carry out the purpose of the subcommittee. The committee may appoint committee members and citizens to a subcommittee, but the committee shall appoint one committee member to serve as chairperson of each subcommittee created under this paragraph. If the committee appoints citizens to a subcommittee, the committee shall appoint citizens who have the scientific and technical expertise to carry out the purpose of the subcommittee.

AB722-ASA2,3,5 (f) All agencies shall fully cooperate with and assist the committee and any subcommittee created under par. (e).

AB722-ASA2,3,7 (g) The committee shall report from time to time its findings and legislative and other recommendations to the joint legislative council.

AB722-ASA2,3,11 (h) The joint legislative council shall pay the actual and necessary expenses incurred by the members appointed under par. (b) and by citizen members of any subcommittee created under par. (e), in performing their functions on the committee or a subcommittee, from the appropriation account under s. 20.765 (3) (e).

AB722-ASA2, s. 2 Section 2. 13.83 (4) of the statutes, as created by 1995 Wisconsin Act .... (this act), is repealed.

AB722-ASA2, s. 3 Section 3. Nonstatutory provisions.

AB722-ASA2,3,21 (1)  Initial terms of members of environmental science study committee. Notwithstanding the length of terms of the members of the environmental science study committee appointed under section 13.83 (4) (b) of the statutes, as created by this act, 3 members initially appointed to the committee shall be appointed for a term expiring on July 1, 1997, 3 members initially appointed to the committee shall be appointed for a term expiring on July 1, 1998, and 3 members initially appointed to the committee shall be appointed for a term expiring on July 1, 1999.

AB722-ASA2, s. 4 Section 4. Effective dates. This act takes effect on the day after publication, except as follows:

AB722-ASA2,3,24 (1)  The repeal of section 13.83 (4) of the statutes takes effect on July 1, 2000.
