(21) "Zero discharge wastewater treatment system" means a
6treatment work that is designed not to discharge any pollutant into the waters of the
7state or into a publicly owned treatment works and that, if subject to a permit under
8this chapter, is exempted from the requirement to obtain a license under s. 144.44
9(4) or 144.64 (2) because industrial discharges that are point sources subject to
10permits under this chapter are excluded from s. 144.01 (15).

12147.016 Regulation of zero discharge wastewater treatment systems.
13(1) The department shall require permits for and otherwise regulate zero discharge
14wastewater treatment systems to ensure the proper operation of zero discharge
1wastewater treatment systems and to authorize discharges from zero discharge
2wastewater treatment systems in cases of process or equipment malfunction or
3breakdown. The department may delegate responsibility under this subsection to
4the owner of a publicly owned treatment works with a pretreatment program that
5has been approved by the department, including a pretreatment program operated
6by a town sanitary district or metropolitan sewerage district. The owner of a publicly
7owned treatment works to whom the department delegates responsibility under this
8subsection shall regulate zero discharge wastewater treatment systems in
9conformance with this section and rules promulgated under this section.

10(2) The department may promulgate rules for the regulation of zero discharge
11wastewater treatment systems. Any rules promulgated under this subsection shall
12encourage and facilitate the construction and use of zero discharge wastewater
13treatment systems.

14(3) This section does not authorize the department to require the construction
15or use of zero discharge wastewater treatment systems.
