9methods by which nontraditional retailers, such as farmers' markets, may
10participate in the delivery of food stamp benefits under the electronic benefit transfer
11system.

2. The department need not implement a program to deliver food stamp
13benefits by an electronic benefit transfer system if any of the following applies:

a. The department determines that the cost of the electronic benefit transfer
15system would be greater than the cost of another food stamp delivery system.

1b. The department determines that the state may be liable under
