SB625-SSA1,1,5 1An Act to repeal 111.70 (4) (m) 2. and 119.18 (23); and to create 111.70 (4) (m)
23. and 119.18 (24) of the statutes; relating to: authorizing school closings and
3reconstitutions and school program discontinuations and reconstitutions, and
4the reassignment of staff resulting from such actions or subsequent reopenings
5or reinstitutions without regard to seniority, in a 1st class city school district.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB625-SSA1, s. 1 6Section 1. 111.70 (4) (m) 2. of the statutes, as created by 1995 Wisconsin Act
727
, is repealed.
SB625-SSA1, s. 2 8Section 2. 111.70 (4) (m) 3. of the statutes is created to read:
SB625-SSA1,1,149 111.70 (4) (m) 3. Reassignment of municipal employes who perform services for
10a board of school directors, with or without regard to seniority, as a result of the
11decision of the board to close, reconstitute or reopen a school or discontinue,
12reinstitute or reconstitute a school program under s. 119.18 (24), or the impact of any
13such reassignment on the wages, hours or conditions of employment of the municipal
14employes who perform those services.

1Section 3. 119.18 (23) of the statutes, as created by 1995 Wisconsin Act 27, is
2repealed.
SB625-SSA1, s. 4 3Section 4. 119.18 (24) of the statutes is created to read:
SB625-SSA1,2,194 119.18 (24) School and program changes. The board may close or reconstitute
5any school or discontinue or reconstitute any school program that it determines is
6low in performance by adopting a resolution to that effect. If the superintendent of
7schools recommends to the board that a school be closed or reconstituted or that a
8school program be discontinued or reconstituted, he or she shall state the reasons for
9the recommendation in writing. If the board closes or reconstitutes a school or
10discontinues or reconstitutes a school program, the superintendent of schools may
11reassign the staff members of that school or school program without regard to
12seniority in service. If the board reopens or reconstitutes the school or reinstitutes
13or reconstitutes the school program, the superintendent of schools may reassign staff
14members to the school or school program without regard to seniority in service. The
15superintendent of schools may reassign staff members of any school without regard
16to seniority in service if the reassignment is related to the staffing needs of any school
17or school program affected by the closing, reconstitution or reopening of a school or
18the discontinuation, reinstitution or reconstitution of a school program, as
19determined by the superintendent of schools.

SB625-SSA1,3,221 (1) The treatment of section 111.70 (4) (m) 3. of the statutes first applies to
22employes who are affected by a collective bargaining agreement that contains
23provisions inconsistent with that treatment on the day on which the collective

1bargaining agreement expires or is extended, modified or renewed, whichever occurs
2first.
