To 1995 SENATE BILL 7

SB7-ASA1,1,2 1An Act to amend 943.13 (2) (a) and 943.13 (2) (b); and to repeal and recreate
2943.13 (2) (a) and 943.13 (2) (b) of the statutes; relating to: trespass to land.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB7-ASA1, s. 1 3Section 1. 943.13 (2) (a) of the statutes is amended to read:
SB7-ASA1,1,134 943.13 (2) (a) If a sign at least 11 inches square is placed in at least 2
5conspicuous places for every 40 acres to be protected. The sign must carry an
6appropriate notice and the name of the person giving the notice followed by the word
7"owner" if the person giving the notice is the holder of legal title to the land and by
8the word "occupant" if the person giving the notice is not the holder of legal title but
9is a lawful occupant of the land. None of the colors used in the sign may be blaze
10orange.
Proof that appropriate signs as provided in this paragraph were erected or
11in existence upon the premises to be protected prior to the event complained of shall
12be prima facie proof that the premises to be protected were posted as provided in this
13paragraph.

1Section 2. 943.13 (2) (a) of the statutes, as affected by 1995 Wisconsin Act ....
2(this act), is repealed and recreated to read:
SB7-ASA1,2,123 943.13 (2) (a) If a sign at least 11 inches square is placed in at least 2

15foot long, including in a contrasting color other than blaze orange the phrase "private
16land" and the name of the owner, are made in at least 2 conspicuous places for every
1740 acres to be protected.

19(this act), is repealed and recreated to read:
SB7-ASA1,2,2320 943.13 (2) (b) If markings in a color other than blaze orange and at least one
21foot long, including in a contrasting color other than blaze orange the phrase "private
22land" and the name of the owner, are made in at least 2 conspicuous places for every
2340 acres to be protected.
SB7-ASA1, s. 5 24Section 5. Initial applicability.

1(1)  The amendment of section 943.13 (2) (a) and (b) of the statutes first applies
2to notice provided on the effective date of this subsection, regardless of whether the
3signs were erected or the markings were made prior to the effective date of this
4subsection.
SB7-ASA1,3,65 (2)  The repeal and recreation of section 943.13 (2) (a) and (b) of the statutes
6first applies to notice provided on January 1, 1997.
SB7-ASA1, s. 6 7Section 6. Effective dates. This act takes effect on the day after publication,
8except as follows:
SB7-ASA1,3,109 (1) The repeal and recreation of section 943.13 (2) (a) and (b) of the statutes
10takes effect on January 1, 1997.
