18Amtrak or the applicable railroad has agreed to provide rail passenger service on

8a statewide system of freight rail service, to assist intermodal freight movement or
9to provide industry access to a rail line. The loan agreement shall require the
10payment of interest at the rate of return earned by the state investment fund for the
11most recent calendar quarter that ended at least 15 days before the loan was made.

12A loan made under this paragraph shall finance a project that confers a public benefit
13or enhances economic development in this state. Loans made under this paragraph
14shall be paid from the appropriation under s. 20.395 (2) (bu), (bw) or (bx).
AB100-ASA1, s. 2481L 16Section 2481L. 85.15 of the statutes is renumbered 85.15 (1) and amended to

19acquired for highway, airport or any other transportation purpose until the property

23lease of any property under this subsection that has an annual lease obligation in
24excess of $50,000.

1public event for which an admission fee is charged for spectators if the event is
2organized by a private organization. The department may not impose a fee for such
3services except as provided in this section. All moneys received under this subsection
4shall be deposited in the general fund and credited to the appropriation account
5under s. 20.395 (5) (dg).

10progress days, the department is prohibited from charging any sponsor of farm

14under sub. (1) and determining the conditions that shall be satisfied to qualify as

18this section:
AB100-ASA1,1139,1919 (ac) "Capital project" has the meaning given in 49 USC 5302.
AB100-ASA1,1139,2320 (ag) "Eligible applicant" means a county, city, village, town or combination
21thereof, Amtrak, as defined in s. 85.061 (1), a railroad, as defined in s. 85.01 (5), a
22private nonprofit organization that is an eligible applicant under s. 85.22 (2) (am),
23or a transit commission created under s. 59.58 (2) or 66.943.
AB100-ASA1,1139,2524 (am) "Fund" means the transportation infrastructure loan fund established
25under s. 25.405.

1(bm) "Other assistance" has the meaning given in P.L. 104-59, section 350 (L)
2(3).
AB100-ASA1,1140,33 (c) "Revenue obligation" has the meaning given in s. 18.52 (5).
AB100-ASA1,1140,8 4(2) Acceptance of federal capitalization grants. The department may enter
5into an agreement with the U.S. department of transportation to receive a
6capitalization grant under P.L. 104-59, section 350. The agreement may contain any
7provision required by P.L. 104-59, section 350, and any regulation, guideline or
8policy adopted under that section.
AB100-ASA1,1140,18 9(3) Administration. (a) The department shall administer a transportation
10infrastructure loan program to make loans, and to provide other assistance, to
11eligible applicants for highway projects or transit capital projects. The department
12of transportation may not make a loan or provide other assistance under the program
13unless the secretary of administration approves of the loan or other assistance and
14determines that the amounts in the fund, together with anticipated receipts, will be
15sufficient to fully pay principal and interest costs incurred on the revenue obligations
16issued under sub. (5). Loans or other assistance under the program for highway
17projects shall be credited to the highway account. Loans or other assistance under
18the program for transit capital projects shall be credited to the transit account.
AB100-ASA1,1140,2319(bm) Any loan made under the program shall comply with P.L. 104-59, section
20350, and any regulation, guideline or policy adopted under that section. The
21department may not provide other assistance under the program to an eligible
22applicant unless such assistance complies with P.L. 104-59, section 350, and any
23regulation, guideline or policy adopted under that section.
AB100-ASA1,1141,924 (cm) The joint committee on finance may transfer moneys, at the request of the
25department, in amounts not to exceed the amounts necessary to meet the

1requirements under P.L. 104-59, section 350, from the transportation fund to the
2transportation infrastructure loan fund. The department shall submit to the joint
3committee on finance for its review and approval proposed reductions among the
4transportation fund appropriations to the department equal to the amount
5transferred under this paragraph. The joint committee on finance may approve,
6disapprove or modify the proposed reductions. Upon approval of the proposed
7reductions, as may be modified by the committee, an amount equivalent to each
8approved reduction is lapsed from the appropriation account for each reduced
9appropriation to the transportation fund.
AB100-ASA1,1141,1210 (dm) Except as provided in this section, the department may not encumber or
11expend any funds on highway projects or transit capital projects for which a loan or
12other assistance is provided under this section.
