ASSEMBLY AMENDMENT 3, TO 1997 ASSEMBLY BILL 104

AB104-AA3,1,1 At the locations indicated, amend the bill as follows:

AB104-AA3,1,3 1. Page 1, line 2: after "sex" insert "and obtaining consent of a same-sex spouse for medical procedures".

AB104-AA3,1,4 2. Page 1, line 3: delete that line and substitute:

AB104-AA3,1,5 " Section 1f. 146.97 of the statutes is created to read:

AB104-AA3,1,11 146.97 Spousal consent for medical procedures. A health care provider whose practice it is to obtain the consent of the spouse of an incapacitated patient prior to performing a medical procedure shall, for the purpose of obtaining that consent, recognize the same-sex spouse of an incapacitated patient as the spouse of the incapacitated patient if the same-sex spouse and the incapacitated patient have a marriage together that is recognized in another state.
