TO 1997 ASSEMBLY BILL 139

AB139-ASA1,1,6 1An Act to renumber and amend 45.25 (4) (b), 45.351 (2) (c), 45.356 (6), 45.396
2(6) and 45.74 (6); to amend 45.356 (2); and to create 45.25 (4) (b) 1. and 2.,
345.351 (2) (c) 1. to 3., 45.356 (6) (a) to (c), 45.396 (6) (a) and (b) and 45.74 (6) (a)
4and (b) of the statutes; relating to: veterans benefits for veterans who are
5delinquent in child or spousal support, maintenance, medical expenses or birth
6expenses.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB139-ASA1, s. 1 7Section 1. 45.25 (4) (b) of the statutes is renumbered 45.25 (4) (b) (intro.) and
8amended to read:
AB139-ASA1,2,29 45.25 (4) (b) (intro.) The department may not provide reimbursement under
10sub. (2) to an individual who is delinquent in child support or maintenance payments
11or who owes past support, medical expenses or birth expenses, as established by the

1receipt by the department of a certification under s. 49.855 ., only if the individual
2provides the department with one of the following:

AB139-ASA1,2,74 45.25 (4) (b) 1. A repayment agreement that the individual has entered into,
5that has been accepted by the county child support agency under s. 59.53 (5) and that
6has been kept current for the 6-month period immediately preceding the date of the
7application.
AB139-ASA1,2,118 2. A statement that the individual is not delinquent in child support or
9maintenance payments and does not owe past support, medical expenses or birth
10expenses, signed by the clerk of circuit court within 7 days before the date of the
11application.
AB139-ASA1, s. 3 12Section 3. 45.351 (2) (c) of the statutes is renumbered 45.351 (2) (c) (intro.) and
13amended to read:

15loan under this subsection if after the department receives a certification under s.
1649.855 (7) that the person applicant is delinquent in child support or maintenance
17payments or owes past support, medical expenses or birth expenses. only if the

AB139-ASA1,2,2320 45.351 (2) (c) 1. Provides to the department a repayment agreement that the
21applicant has entered into, that has been accepted by the county child support
22agency under s. 59.53 (5) and that has been kept current for the 6-month period
23immediately preceding the date of the application.
AB139-ASA1,3,224 2. Provides to the department a statement that the applicant is not delinquent
25in child support or maintenance payments and does not owe past support, medical

1expenses or birth expenses, signed by the clerk of circuit court within 7 days before
2the date of the application.
AB139-ASA1,3,53 3. Agrees to use the loan proceeds to pay any delinquent child support or
4maintenance payments and to pay any past support, medical expenses or birth
5expenses if the applicant fails to meet the requirements under subd. 1. or 2.
AB139-ASA1, s. 5 6Section 5. 45.356 (2) of the statutes is amended to read:
AB139-ASA1,3,137 45.356 (2) The department may lend a veteran not more than $15,000 for the
8purchase of a mobile home, business or business property, the repair of or addition
9to his or her home or business property, the construction of a garage, the education
10of the veteran or his or her spouse or children, the payment of medical or funeral
11expenses, the payment under sub. (6) (c) or the consolidation of debt. The
12department may prescribe loan conditions, but the term of the loan may not exceed
1310 years.

15amended to read:

6maintenance payments and to pay any past support, medical expenses or birth
7expenses if the applicant fails to meet the requirements under par. (a) or (b).

9amended to read:
AB139-ASA1,4,1410 45.396 (6) (intro.) The department may not make a grant to a person an
11applicant
under this section if it after the department receives a certification under
12s. 49.855 (7) that the person applicant is delinquent in child support or maintenance
13payments or owes past support, medical expenses or birth expenses. only if the
14applicant provides the department with one of the following:
