ASSEMBLY SUBSTITUTE AMENDMENT 1,
TO 1997 ASSEMBLY BILL 20

AB20-ASA1,1,4 1An Act to renumber and amend 120.18 (1) (a); to amend 43.70 (1), 43.70 (2),
2119.32 (6) and 120.08 (2) (a); and to create 120.18 (1) (a) 1., 2. and 3. of the
3statutes; relating to: the method of determining the number of children
4residing in a school district for purposes of taking an annual school count
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB20-ASA1, s. 1 5Section 1. 43.70 (1) of the statutes is amended to read:
AB20-ASA1,1,116 43.70 (1) No later than October 15 of each year, each school district
7administrator shall certify to the department, on forms provided by the department,
8a report of the total number of children persons between the ages of 4 and 20 years
9residing in the school district on the preceding June 30. The number may be
10estimated determined by using statistically significant sampling techniques that
11have been approved by the department
one of the methods under s. 120.18 (1) (a).
AB20-ASA1, s. 2 12Section 2. 43.70 (2) of the statutes is amended to read:

143.70 (2) Annually, within 40 days after December 1, the department shall
2ascertain the aggregate amount of all moneys received as income in the common
3school fund prior to that December 1 and shall apportion such amount to the school
4districts in proportion to the number of children persons resident therein between
5the ages of 4 and 20 years, as shown by the census report certified under sub. (1).
AB20-ASA1, s. 3 6Section 3. 119.32 (6) of the statutes is amended to read:
AB20-ASA1,2,137 119.32 (6) The superintendent of schools shall take an annual census count of
8all persons between the ages of 4 and 20 residing in the city and at the same time shall
9collect such additional statistics and information relating to schools and the
10population entitled to school privileges in the city as the board directs. The census
11count may be estimated determined by using statistically significant sampling
12techniques that have been approved by the department

AB20-ASA1, s. 4 14Section 4. 120.08 (2) (a) of the statutes is amended to read:
AB20-ASA1,2,2215 120.08 (2) (a) Upon petition filed with the school district clerk signed by 3% of
16the number of heads of families residing in the school district as enumerated by the
17last school census count or 100 electors, whichever is less fewer, or upon the motion
18of the school board in a common or union high school district, a special meeting shall
19be called by the school district clerk or, in his or her absence, by the school district
20president or school district treasurer. If the petition includes a subject beyond the
21power of the special meeting to transact, the school district clerk shall reject such
22subject and so notify each elector signing the petition.

16the school district and who were enrolled in private schools, home-based private
17educational programs or other school districts on the 3rd Friday of September of the
18previous school year; plus the number or an estimate of the number of those persons
19aged 4 to 20 who were residents of the school district and not enrolled in the school
20district, private schools, home-based private educational programs or other school
21districts on the 3rd Friday of September of the previous school year.
AB20-ASA1, s. 7 22Section 7. Effective date.
AB20-ASA1,3,2323 (1) This act takes effect on July 1, 1998.
