ASSEMBLY SUBSTITUTE AMENDMENT 1,
TO 1997 ASSEMBLY BILL 220

AB220-ASA1,1,4 1An Act to create 448.15, 939.66 (8), 940.16 and 971.10 (3) (d) of the statutes;
2relating to: prohibiting performance of certain partial-birth abortions,
3providing for review of partial-birth abortions by the medical examining board,
4granting rule-making authority and providing a penalty.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB220-ASA1, s. 1 5Section 1. 448.15 of the statutes is created to read:
AB220-ASA1,1,7 6448.15 Review of partial-birth abortions. (1) In this section,
7"partial-birth abortion" has the meaning given in s. 940.16 (1) (a).
AB220-ASA1,2,2 8(2) At the request of a physician charged with a violation of s. 940.16 (2), the
9board shall conduct a hearing as to whether the physician's performance of the
10partial-birth abortion was necessary to save the life of a woman whose life is
11endangered by a physical disorder, physical illness or physical injury, including a

1life-endangering physical disorder, physical illness or physical injury caused by or
2arising from the pregnancy itself, as provided in s. 940.16 (3).
AB220-ASA1,2,4 3(3) The findings by the board at a hearing under sub. (2) may be admitted at
4the criminal trial of the physician who requested the hearing.
AB220-ASA1,2,6 5(4) The board shall promulgate rules relating to the conduct of hearings under
6sub. (2).
AB220-ASA1, s. 2 7Section 2. 939.66 (8) of the statutes is created to read:
AB220-ASA1,2,98 939.66 (8) The crime specified in s. 940.15 (2) when the crime charged is
9specified in s. 940.16 (2).
AB220-ASA1, s. 3 10Section 3. 940.16 of the statutes is created to read:
AB220-ASA1,2,11 11940.16 Partial-birth abortion. (1) In this section:
AB220-ASA1,2,1312 (a) "Partial-birth abortion" means a procedure consisting of the following
13sequence of acts:
AB220-ASA1,2,1414 1. The uterine cervix of a pregnant woman is dilated.
AB220-ASA1,2,1515 2. The fetus is rotated so that its feet are the presenting part.
AB220-ASA1,2,1716 3. The feet of the fetus are pulled past the vaginal introitus and the arms and
17shoulders of the fetus are passed through the uterine cervix.
AB220-ASA1,2,1818 4. A scissors is used to pierce the base of the skull of the fetus.
AB220-ASA1,2,2019 5. A suction curette is inserted into the opening at the base of the skull made
20by the scissors and the cranial contents are suctioned from the skull.
AB220-ASA1,2,2121 6. The skull of the fetus is crushed or collapsed.
AB220-ASA1,2,2222 7. Delivery of the fetus is completed.
AB220-ASA1,2,2323 (b) "Viability" has the meaning given in s. 940.15 (1).

1(2) Except as provided in sub. (3), whoever intentionally performs a
2partial-birth abortion after the fetus reaches viability, as determined by reasonable
3medical judgment of the woman's attending physician, is guilty of a Class E felony.
AB220-ASA1,3,7 4(3) Subsection (2) does not apply if the partial-birth abortion is necessary to
5save the life of a woman whose life is endangered by a physical disorder, physical
6illness or physical injury, including a life-endangering physical disorder, physical
7illness or physical injury caused by or arising from the pregnancy itself.
AB220-ASA1, s. 4 8Section 4. 971.10 (3) (d) of the statutes is created to read:
AB220-ASA1,3,159 971.10 (3) (d) Notwithstanding par. (a), the court shall grant a continuance to
10a physician charged with a violation of s. 940.16 (2) if the physician has requested
11a hearing before the medical examining board under s. 448.15 (2) and the hearing
12has not yet taken place. The continuance shall be of sufficient length to permit the
13hearing under s. 448.15 (2) to be held. A motion for a continuance filed under this
14paragraph extends the time limit for commencing the trial under sub. (2) (a) by the
15number of days for which the continuance is granted.
