AB221-ASA1,1,2 1An Act to create 940.20 (8) and 940.20 (9) of the statutes; relating to: causing
2bodily harm to a viable fetus or a pregnant woman and providing penalties.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB221-ASA1, s. 1 3Section 1. 940.20 (8) of the statutes is created to read:
AB221-ASA1,1,54 940.20 (8) Battery to viable fetus. (a) In this subsection, "viability" has the
5meaning given in s. 940.15 (1).
AB221-ASA1,1,86 (b) Whoever intentionally causes bodily harm to a fetus that has reached
7viability by an act done without the consent of the pregnant woman is guilty of a
8Class C felony.
AB221-ASA1, s. 2 9Section 2. 940.20 (9) of the statutes is created to read:
AB221-ASA1,2,210 940.20 (9) Battery to pregnant woman. Whoever intentionally causes bodily
11harm to a pregnant woman by an act done without the consent of the woman and

1knowing or having reason to know that the woman is pregnant is guilty of a Class
2D felony.
AB221-ASA1, s. 3 3Section 3. Initial applicability.
AB221-ASA1,2,54 (1)  This act applies to offenses occurring on or after the effective date of this
5subsection.
