ASSEMBLY SUBSTITUTE AMENDMENT 1, TO 1997 ASSEMBLY BILL 269

AB269-ASA1,1,4 An Act to amend 40.23 (1) (a) 1. and 40.26 (5) (a); and to create 40.23 (1) (a) 1m. of the statutes; relating to: the period of separation from covered employment required under the Wisconsin retirement system for an annuitant under the Wisconsin retirement system.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB269-ASA1, s. 1 Section 1. 40.23 (1) (a) 1. of the statutes is amended to read:

AB269-ASA1,1,12 40.23 (1) (a) 1. The For a participant who was a teacher employed by a school district and who engaged in classroom instruction immediately prior to separation, the participant is separated, regardless of cause, and continues to be separated until the annuity effective date, the date 30 days after the application is received by the department or the date 30 days after separation, whichever is later latest, from all employment meeting the qualifications for inclusion specified in s. 40.22 for any participating employer.

AB269-ASA1, s. 2 Section 2. 40.23 (1) (a) 1m. of the statutes is created to read:

AB269-ASA1,2,7 40.23 (1) (a) 1m. For a participant not specified in subd. 1., the participant is separated, regardless of cause, and continues to be separated until the annuity effective date, the date 120 days after the application is received by the department or the date 30 days after separation, whichever is latest, from all employment meeting the qualifications for inclusion specified in s. 40.22 for any participating employer.

AB269-ASA1, s. 3 Section 3. 40.26 (5) (a) of the statutes is amended to read:

AB269-ASA1,2,10 40.26 (5) (a) The participant shall not qualify for an annuity under s. 40.23 (1) (a) 1. or 1m.

AB269-ASA1, s. 4 Section 4. Initial applicability.

AB269-ASA1,2,14 (1) This act applies to participating employes under the Wisconsin retirement system who terminate covered employment under the Wisconsin retirement system on or after the effective date of this subsection.
