AB351-ASA1-AA1,1,1 At the locations indicated, amend the substitute amendment as follows:

AB351-ASA1-AA1,1,2 1. Page 19, line 17: after that line insert:

AB351-ASA1-AA1,1,3 " Section 50g. 301.046 (3) (intro.) of the statutes is amended to read:

AB351-ASA1-AA1,1,7 301.046 (3) Eligibility. (intro.) The department shall determine those prisoners who are confined under sub. (1). Except as provided in sub. subs. (3m) and (3t), a prisoner is eligible for this confinement only under all of the following conditions:

AB351-ASA1-AA1, s. 50r Section 50r. 301.046 (3t) of the statutes is created to read:

AB351-ASA1-AA1,1,12 301.046 (3t) Persons serving bifurcated sentence; restricted eligibility. A prisoner serving a bifurcated sentence imposed under s. 973.01 is not eligible for confinement under sub. (1) during the term of confinement in prison portion of the bifurcated sentence.".

AB351-ASA1-AA1,2,2 " Section 51m. 301.048 (2) (b) of the statutes is amended to read:

AB351-ASA1-AA1,2,6 301.048 (2) (b) He or she is a prisoner serving a felony sentence not punishable by life imprisonment and the department directs him or her to participate in the program. This paragraph does not apply to a prisoner serving a bifurcated sentence imposed under s. 973.01.".

AB351-ASA1-AA1,2,8 " Section 53m. 301.048 (2m) of the statutes is created to read:

AB351-ASA1-AA1,2,12 301.048 (2m) Persons serving bifurcated sentence; restricted eligibility. A prisoner serving a bifurcated sentence imposed under s. 973.01 is not eligible for the intensive sanctions program during the term of confinement in prison portion of the bifurcated sentence.".

AB351-ASA1-AA1,2,13 4. Page 90, line 4: delete lines 4 to 7 and substitute:

AB351-ASA1-AA1,2,14 " Section 280m. 973.032 (1) of the statutes is amended to read:

AB351-ASA1-AA1,2,19 973.032 (1) Sentence. Beginning July 1, 1992, a court may sentence a person who is convicted of a felony occurring on or after August 15, 1991, but before July 1, 1998, to participate in the intensive sanctions program under s. 301.048. If a person is convicted of a felony occurring on or after July 1, 1998, a court may not sentence the person to participate in the intensive sanctions program under s. 301.048.".
