AB351-ASA1-AA10,1,2 21. Page 19, line 17: after that line insert:
AB351-ASA1-AA10,1,3 3" Section 50m. 301.03 (13) of the statutes is created to read:
AB351-ASA1-AA10,1,104 301.03 (13) Develop guidelines for use by judges for sentencing defendants
5convicted of felonies. The guidelines shall be based on sentencing experience in this
6state and shall be periodically revised. The guidelines may contain actual
7recommended sentence lengths, including the lengths of terms of confinement in
8prison and terms of extended supervision for bifurcated sentences imposed under s.
9973.01, based on the character and history of the offender and the severity of the
10offense.".

1"(3g) Use of sentencing guidelines. When imposing a sentence under this
2section, the court shall take into consideration the guidelines established by the
3department of corrections under s. 301.03 (13). There shall be no right to appeal on
4the basis of the sentencing court's decision to impose a sentence that does not fall
5within the sentencing guidelines.".
