SENATE AMENDMENT 2, TO SENATE SUBSTITUTE AMENDMENT 1, TO 1997 ASSEMBLY BILL 351

AB351-SSA1-SA2,1,1 At the locations indicated, amend the substitute amendment as follows:

AB351-SSA1-SA2,1,3 1. Page 4, line 24: after "supervision," insert "prisoner access to personal information, contract authority of the department of corrections,".

AB351-SSA1-SA2,1,4 2. Page 71, line 5: after that line insert:

AB351-SSA1-SA2,1,5 " Section 222q. 303.064 of the statutes is created to read:

AB351-SSA1-SA2,1,10 303.064 Contracts requiring prisoner access to personal information. (1) In this section, "personal information" includes an individual's address, telephone number, social security number, marital status, gender, race, religious affiliation, date or place of birth, place of or type of employment or any other information that may be used to identify an individual.

AB351-SSA1-SA2,2,3 (2) The department may not enter into any contract or other agreement if, in the performance of the contract or agreement, a prisoner would have access to any personal information relating to an individual who is not a prisoner.".

AB351-SSA1-SA2,2,4 3. Page 141, line 19: after that line insert:

AB351-SSA1-SA2,2,7 "(2t) Prisoner access to personal information. The treatment of section 303.064 of the statutes first applies to contracts entered into or renewed by the department of corrections on the effective date of this subsection.".
