1An Act to amend 23.33 (4c) (a) 3., 23.33 (13) (b) 4., 350.101 (1) (c) and 350.11 (3)
2(a) 4.; and
to create 30.681 (1) (b) 3. and 30.80 (6) (a) 4. of the statutes;
relating
3to: raising the age of those persons who may not drive or operate an all-terrain
4vehicle, motorboat or snowmobile with any alcohol in their blood to the legal
5drinking age and providing a penalty.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1. 23.33 (4c) (a) 3. of the statutes is amended to read:

(4c) (a) 3. (title) `Operating with alcohol concentrations at specified
8levels; below
age 19 the legal drinking age.' If a person has not attained the
age of
919 legal drinking age, as defined in s. 125.02 (8m), the person may not engage in the
10operation of an all-terrain vehicle while he or she has an alcohol concentration of
11more than 0.0 but not more than 0.1.

age of 19 legal drinking age, as defined in s. 125.02 (8m), shall
21forfeit not more than $50.

(1) This act first applies to offenses committed or refusals occurring on the
24effective date of this subsection, but does not preclude the counting of other
25convictions, suspensions or revocations as prior convictions, suspensions or
1revocations for purposes of determining the prohibited alcohol concentration,
2administrative action by the department of transportation, sentencing by a court or
3revocation or suspension of operating privileges.
