ASSEMBLY AMENDMENT 1, TO 1997 ASSEMBLY BILL 428

AB428-AA1,1,1 At the locations indicated, amend the bill as follows:

AB428-AA1,1,3 1. Page 2, line 6: delete "A county" and substitute "Except as provided in sub. (6), a county".

AB428-AA1,1,4 2. Page 2, line 22: after that line insert:

AB428-AA1,1,12 "(6) No county clerk may refuse to issue a marriage license under s. 765.12 solely because a party applying for a marriage license refuses to submit to a test for the presence of HIV if each party intending to marry swears or affirms by affidavit provided to the county clerk that the refusal is grounded in a sincerely held religious belief. If one of the parties intending to marry refuses to swear or affirm by affidavit that the refusal to submit to a test for HIV is grounded in a sincerely held religious belief, a county clerk may not issue a marriage license unless each party intending to marry complies with the requirements of sub. (2) (a) and (b).".
