ASSEMBLY SUBSTITUTE AMENDMENT 1, TO 1997 ASSEMBLY BILL 437

AB437-ASA1,1,3 An Act to renumber and amend 350.05 (3); and to create 350.01 (10p), 350.01 (11m), 350.05 (3) (b) and 350.15 (6) of the statutes; relating to: the operation of snowmobiles in races or derbies or on raceway facilities.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB437-ASA1, s. 1 Section 1. 350.01 (10p) of the statutes is created to read:

AB437-ASA1,1,8 350.01 (10p) "Raceway facility" means an area for a sanctioned snowmobile race or derby, including any training, warm-up or testing area, that has been designated for a sanctioned race or derby and that meets any applicable requirements under s. 350.04 (1) and (3) (b).

AB437-ASA1, s. 2 Section 2. 350.01 (11m) of the statutes is created to read:

AB437-ASA1,1,12 350.01 (11m) "Sanctioned race or derby" means a competitive snowmobile event sponsored by a county, town, city or village, by a promoter, by a chamber of commerce or by a snowmobile club or other similar organization.

AB437-ASA1, s. 3 Section 3. 350.05 (3) of the statutes is renumbered 350.05 (3) (a) and amended to read:

AB437-ASA1,2,7 350.05 (3) (a) This section does not apply to the operation of snowmobiles by an operator under the age of 16 years who is operating a snowmobile upon lands owned or leased by the operator's parent or guardian. As used in this section, "leased lands" does not include lands leased by an organization of which said operator or the operator's parent or guardian is a member.

AB437-ASA1, s. 4 Section 4. 350.05 (3) (b) of the statutes is created to read:

AB437-ASA1,2,11 350.05 (3) (b) This section does not apply to a person who is over the age of 9 and under the age of 16 who is operating a snowmobile in a sanctioned race or derby or on a raceway facility if all of the following apply:

AB437-ASA1,2,13 1. The snowmobile is equipped with a fan-cooled motor that is not more than 400 cubic centimeters.

AB437-ASA1,2,15 2. The person has obtained permission from his or her parent or guardian to operate the snowmobile in the sanctioned race or derby or on the raceway facility.

AB437-ASA1,2,17 3. A parent or guardian of the person is present at the sanctioned race or derby or at the raceway facility.

AB437-ASA1, s. 5 Section 5. 350.15 (6) of the statutes is created to read:

AB437-ASA1,2,22 350.15 (6) Summary reports. In preparing reports that summarize the number of snowmobile accidents according to type, severity, date of occurrence or any other classification, the department may not include accidents that occur in sanctioned races or derbies or on raceway facilities.
