(13m) Cigarette or tobacco product treatment or education. (a) If
2the report prepared under s. 48.33 (1) recommends that a child expectant mother is
3in need of treatment for the use or abuse of cigarettes or tobacco products and their
4medical, personal, family or social effects, the court may order the child expectant
5mother to enter an outpatient cigarette and tobacco products cessation program. The
6person or agency that provides the cessation program shall report to the agency
7primarily responsible for providing services to the child expectant mother as to
8whether the child expectant mother is cooperating with the treatment and whether
9the treatment appears to be effective.

(b) If the report prepared under s. 48.33 (1) recommends that a child expectant
11mother is in need of education relating to the use of cigarettes or tobacco products,
12the court may order the child expectant mother to participate in a cigarette or tobacco
13product education program approved by the court. The person or agency that
14provides the education program shall report to the agency primarily responsible for
15providing services to the child expectant mother about the child expectant mother's
16attendance at the program.".
