Section 180m. 48.345 (13m) of the statutes is created to read:

(13m) Cigarette or tobacco product treatment or education. (a) If
12the report prepared under s. 48.33 (1) recommends that a child expectant mother is
13in need of treatment for the use or abuse of cigarettes or tobacco products and their
14medical, personal, family or social effects, the court may order the child expectant
15mother to enter an outpatient tobacco use cessation program. The person or agency
16that provides the cessation program shall report to the agency primarily responsible
17for providing services to the child expectant mother as to whether the child expectant
18mother is cooperating with the treatment and whether the treatment appears to be
19effective.

(b) If the report prepared under s. 48.33 (1) recommends that a child expectant
21mother is in need of education relating to the use of cigarettes or tobacco products,
22the court may order the child expectant mother to participate in a cigarette or tobacco
23product education program approved by the court. The person or agency that
24provides the education program shall report to the agency primarily responsible for
1providing services to the child expectant mother about the child expectant mother's
2attendance at the program.".

9personal, family or social effects, the court may order the adult expectant mother to

12providing services to the adult expectant mother as to whether the adult expectant
13mother is cooperating with the treatment and whether the treatment appears to be
14effective.

1"2m. "Cigarette or tobacco product abuse services" means any services relating
2to the prevention, education, diagnosis, evaluation, assessment, treatment,
3rehabilitation or care of a person suffering from a habitual lack of self-control in the
4use of cigarettes or tobacco products, exhibited to a severe degree.

2r. "Cigarette or tobacco product abuse services provider" means a physician,
6nurse or other medical professional, a psychologist, social worker, marriage and
7family therapist, professional counselor, school counselor, cigarette or tobacco
8product abuse counselor or other mental health professional, a member of the
9treatment staff employed by or working under contract with a county department
10under s. 46.23, 51.42 or 51.437 or any other person who is providing cigarette or
11tobacco product abuse services.".
