AB639-ASA2,1,3 1An Act to create 349.025 of the statutes; relating to: prohibiting requirements
2that law enforcement officers meet citation or arrest quotas in the enforcement
3of state and local traffic laws.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB639-ASA2, s. 1 4Section 1. 349.025 of the statutes is created to read:
AB639-ASA2,1,6 5349.025 Quotas relating to the enforcement of traffic regulations
6prohibited.
(1) In this section:
AB639-ASA2,1,77 (a) "Law enforcement officer" has the meaning given in s. 164.01.
AB639-ASA2,1,98 (b) "Traffic regulation" means a provision of chs. 194 or 341 to 348 or an
9ordinance enacted in accordance with this chapter.
AB639-ASA2,1,10 10(2) No law enforcement officer may be required to do any of the following:
AB639-ASA2,1,1211 (a) Issue a specific number of citations, complaints or warning notices during
12any specified time period for violations of traffic regulations.

1(b) Stop a specific number of persons or vehicles during any specified time
2period for the purpose of preventing or detecting violations of traffic regulations.
AB639-ASA2,2,43 (c) Make a specific number of arrests during any specified time period for
4violations of traffic regulations.
AB639-ASA2,2,10 5(3) The number of citations, complaints or warning notices issued by a law
6enforcement officer for violations of traffic regulations and the number of traffic
7stops and arrests made by a law enforcement officer for violations of traffic
8regulations may not be given greater consideration than any other factor that is used
9in deciding the law enforcement officer's job assignment or promotion or in
10evaluating the performance of the law enforcement officer.
AB639-ASA2,2,13 11(4) Subsections (2) and (3) may not be construed as superseding the duty of a
12law enforcement officer to maintain public order, keep and preserve the peace,
13protect the public health, safety and welfare and enforce the laws of this state.
