ASSEMBLY SUBSTITUTE AMENDMENT 1, TO 1997 ASSEMBLY BILL 709

AB709-ASA1,1,4 An Act to amend 69.21 (2) (c), 69.22 (1) (b) and 69.24 (1) (a); and to create 69.21 (2) (d) and 69.24 (1) (am) of the statutes; relating to: issuance of uncertified copies of vital records for events occurring before October 1, 1907, and providing penalties.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB709-ASA1, s. 1 Section 1. 69.21 (2) (c) of the statutes is amended to read:

AB709-ASA1,1,7 69.21 (2) (c) Any uncertified copy issued under this subsection par. (a) or (b) shall have on its face a notice that it is uncertified.

AB709-ASA1, s. 2 Section 2. 69.21 (2) (d) of the statutes is created to read:

AB709-ASA1,2,2 69.21 (2) (d) 1. An uncertified photocopy of a vital record for an event occurring before October 1, 1907, other than a vital record held by the state registrar and any local registrar, is subject to this paragraph and may not be made available to the public in electronic format, but is not otherwise subject to the limitations of this section or the requirements of s. 69.22.

AB709-ASA1,2,6 2. An uncertified photocopy of a vital record described in subd. 1. shall have on its face the following text: "UNCERTIFIED COPY. Not valid for identification purposes. It is illegal to make this document available to the public in electronic format.".

AB709-ASA1,2,8 3. The holder of the vital record from which uncertified photocopies may be made and issued under this paragraph may establish fees for the photocopies.

AB709-ASA1, s. 3 Section 3. 69.22 (1) (b) of the statutes is amended to read:

AB709-ASA1,2,12 69.22 (1) (b) Except as provided under par. (c), $7 for any uncertified copy of a vital record issued under s. 69.21 (2) (a) or (b) or for verifying information submitted by a requester without issuance of a copy.

AB709-ASA1, s. 4 Section 4. 69.24 (1) (a) of the statutes is amended to read:

AB709-ASA1,2,19 69.24 (1) (a) Prepares Other than as authorized under s. 69.21 (2) (d), prepares or issues any paper or film which purports to be, or carries the appearance of, an original or a copy of a vital record, certified or uncertified, except as provided under this subchapter or s. 610.50 and except for any hospital which issues any written announcement of the birth of a person to the parents of the person if the announcement contains plain notice that the announcement is not for official use.

AB709-ASA1, s. 5 Section 5. 69.24 (1) (am) of the statutes is created to read:

AB709-ASA1,2,23 69.24 (1) (am) Makes available to the public in electronic format an uncertified photocopy of a vital record for an event occurring before October 1, 1907, that is issued under s. 69.21 (2) (d).
