ASSEMBLY AMENDMENT 12, TO ASSEMBLY SUBSTITUTE AMENDMENT 1, TO 1997 ASSEMBLY BILL 768

AB768-ASA1-AA12,1,1 At the locations indicated, amend the substitute amendment as follows:

AB768-ASA1-AA12,1,5 1. Page 14, line 16: after "program;" insert "requiring physicians to report injuries to, and deaths of, minors that they suspect are caused by articles intended for use by minors and requiring the secretary of agriculture, trade and consumer protection to publicize dangers created by such articles;".

AB768-ASA1-AA12,1,6 2. Page 249, line 10: after that line insert:

AB768-ASA1-AA12,1,7 " Section 322bm. 93.25 of the statutes is created to read:

AB768-ASA1-AA12,1,11 93.25 Public notice. If the secretary determines that a consumer product, as defined in s. 100.42 (1) (c), that is intended for use by a minor creates an unreasonable risk of injury or imminent hazard to the public health, welfare or safety, the secretary shall ensure that adequate notice of that risk or hazard is given to the public.".

AB768-ASA1-AA12,2,1 " Section 393qm. 146.995 (title) of the statutes is amended to read:

AB768-ASA1-AA12,2,3 146.995 (title) Reporting of injuries and deaths caused by children's products, wounds and burn injuries.

AB768-ASA1-AA12, s. 393m Section 393m. 146.995 (2m) of the statutes is created to read:

AB768-ASA1-AA12,2,10 146.995 (2m) Any physician who reasonably suspects that an injury to a minor whom the physician treats or the death of a minor was caused by a consumer product, as defined in s. 100.42 (1) (c), that is intended for use by a minor shall report the consumer product's name, any other identifying information and the type of injury or death involved as soon as reasonably possible to the department of agriculture, trade and consumer protection.

AB768-ASA1-AA12, s. 393qp Section 393qp. 146.995 (3) of the statutes is amended to read:

AB768-ASA1-AA12,2,16 146.995 (3) Any person reporting in good faith under sub. (2) or (2m), and any inpatient health care facility that employs the person who reports, are immune from all civil and criminal liability that may result because of the report. In any proceeding, the good faith of any person reporting under this section shall be presumed.".

AB768-ASA1-AA12,2,17 4. Page 576, line 5: after that line insert:

AB768-ASA1-AA12,2,18 " Section 9404. Effective dates; agriculture, trade and consumer protection.

AB768-ASA1-AA12,2,20 (1f) Notice of injury. The treatment of section 93.25 of the statutes takes effect on the first day of the 7th month beginning after publication.".
