ASSEMBLY AMENDMENT 15, TO ASSEMBLY SUBSTITUTE AMENDMENT 1, TO 1997 ASSEMBLY BILL 768

AB768-ASA1-AA15,1,1 At the locations indicated, amend the substitute amendment as follows:

AB768-ASA1-AA15,1,3 1. Page 14, line 7: after "data;" insert "changing the reporting of health care information by physicians to be voluntary, rather than mandatory;".

AB768-ASA1-AA15,1,4 2. Page 311, line 23: after that line insert:

AB768-ASA1-AA15,1,5 " Section 393rt. 153.01 (8m) of the statutes is created to read:

AB768-ASA1-AA15,1,6 153.01 (8m) "Physician" has the meaning given in s. 448.01 (5).

AB768-ASA1-AA15, s. 393ru Section 393ru. 153.05 (1) of the statutes, as affected by 1997 Wisconsin Act 231, is amended to read:

AB768-ASA1-AA15,2,4 153.05 (1) In order to provide to hospitals, health care providers, insurers, consumers, governmental agencies and others information concerning health care providers and uncompensated health care services, and in order to provide information to assist in peer review for the purpose of quality assurance, the department shall collect, analyze and disseminate health care information, as adjusted for case mix and severity, in language that is understandable to lay persons, except that the department may request, but not require, health care information from physicians under this subsection.

AB768-ASA1-AA15, s. 393rv Section 393rv. 153.05 (5) of the statutes, as affected by 1997 Wisconsin Acts 27 and 231, is amended to read:

AB768-ASA1-AA15,2,12 153.05 (5) Unless sub. (13) applies, the department may require health care providers other than physicians and may request physicians to submit to the department information specified by rule under s. 153.75 (1) (n) for the preparation of reports, plans and recommendations in the form specified by the department by rule. Physicians may, but are not required to, provide the information requested by the department under this subsection.

AB768-ASA1-AA15, s. 393rw Section 393rw. 153.05 (8) of the statutes, as affected by 1997 Wisconsin Acts 27 and 231, is amended to read:

AB768-ASA1-AA15,3,2 153.05 (8) Unless sub. (13) applies, the department shall collect, analyze and disseminate, in language that is understandable to lay persons, claims information and other health care information, as adjusted for case mix and severity, under the provisions of this chapter, as determined by rules promulgated by the department, from health care providers specified by rules promulgated by the department, except that the department may request, but not require, health care information from physicians under this subsection. Data from health care providers may be obtained through sampling techniques in lieu of collection of data on all patient encounters and data collection procedures shall minimize unnecessary duplication and administrative burdens. If the department collects health care provider-specific data from health care plans, the department shall attempt to avoid collecting the same data from health care providers.

AB768-ASA1-AA15, s. 393rx Section 393rx. 153.05 (13) of the statutes, as created by 1997 Wisconsin Act 231, is amended to read:

AB768-ASA1-AA15,3,10 153.05 (13) The department may waive the requirement under sub. (1), (5) or (8) for a health care provider, other than a physician, who requests the waiver and presents evidence to the department that the requirement under sub. (1), (5) or (8) is burdensome, under standards established by the department by rule. The department shall develop a form for use by a health care provider in submitting a request under this subsection.".

AB768-ASA1-AA15, s. 393skh Section 393skh. 153.75 (1) (n) of the statutes, as created by 1997 Wisconsin Act 231, is amended to read:

AB768-ASA1-AA15,3,19 153.75 (1) (n) Specifying the uniform data set of health care information, as adjusted for case mix and severity, to be collected or requested.

AB768-ASA1-AA15, s. 393ski Section 393ski. 153.75 (1) (o) of the statutes, as created by 1997 Wisconsin Act 231, is amended to read:

AB768-ASA1-AA15,3,24 153.75 (1) (o) Specifying the means by which the information in par. (b) will be collected or requested, including the procedures for submission of data by electronic means.

AB768-ASA1-AA15, s. 393skj Section 393skj. 153.75 (1) (t) of the statutes, as created by 1997 Wisconsin Act 231, is amended to read:

AB768-ASA1-AA15,4,5 153.75 (1) (t) Establishing standards for determining under s. 153.05 (13) if a requirement under s. 153.05 (1), (5) or (8) is burdensome for a health care provider other than a physician.".
