AB768-ASA1-AA26,1,2 21. Page 12, line 11: after "hearings;" insert "prison impact assessments;".
AB768-ASA1-AA26,1,3 32. Page 18, line 15: after that line insert:
AB768-ASA1-AA26,1,4 4" Section 1g. 13.0975 of the statutes is created to read:
AB768-ASA1-AA26,1,6 513.0975 Prison impact assessments. (1) In this section, "prison" means a
6state prison described under s. 302.01.
AB768-ASA1-AA26,2,2 7(2) The director of state courts shall prepare a prison impact assessment for
8any bill that creates a felony or modifies the period of imprisonment for a felony.
9Except as otherwise provided by the joint rules of the legislature, the director shall
10prepare the assessment within 21 calendar days after the date on which the director
11receives a copy of a bill under sub. (4) or the date on which the director receives a

1request to prepare the assessment from the bill requester, whichever occurs first.
2The assessment shall contain all of the following:
AB768-ASA1-AA26,2,43 (a) Projections of the impact on statewide probationer, prisoner and parolee
4populations.
AB768-ASA1-AA26,2,75 (b) An estimate of the fiscal impact of population changes under par. (a) on state
6expenditures, including expenditures for the construction and operation of state
7prisons for the current fiscal year and the 5 succeeding fiscal years.
AB768-ASA1-AA26,2,108 (c) An analysis of any significant factor, not covered in complying with pars. (a)
9and (b), affecting the cost of the bill and the factor's impact on prosecutors, the state
10public defender and courts.
AB768-ASA1-AA26,2,1211 (d) A statement of the methodologies and assumptions that the director used
12in preparing the assessment.
AB768-ASA1-AA26,2,14 13(3) The legislature shall reproduce and distribute assessments under sub. (2)
14in the same manner as it reproduces and distributes amendments.
AB768-ASA1-AA26,2,18 15(4) A bill that requires an assessment by the director of state courts under this
16section shall have that requirement noted on its jacket when the jacket is prepared.
17When a bill that requires an assessment under this section is introduced, the
18legislative reference bureau shall submit a copy of the bill to the director.
AB768-ASA1-AA26,2,21 19(5) No public hearing before a standing committee may be held and no
20committee vote may be taken regarding any bill described in sub. (2) unless the
21assessment under sub. (2) has been prepared.
AB768-ASA1-AA26,2,25 22(6) Annually, by March 1, the director of state courts shall submit to the
23legislature under s. 13.172 (2) a prison impact assessment reflecting the cumulative
24effect of all relevant changes in the statutes taking effect during the preceding
25calendar year.

1(7) The department of corrections shall provide the director of state courts with
2information on current and past admissions and on length of time served as needed
3by the director in order to prepare assessments under subs. (2) and (6).
AB768-ASA1-AA26,3,5 4(8) The circuit courts shall provide the director of state courts with information
5to assist the director in preparing assessments under subs. (2) and (6).
AB768-ASA1-AA26,3,7 6(9) This section applies to bills introduced or requests for assessments made
7after December 31, 1999.".

AB768-ASA1-AA26,3,11 9"(3fw) Transfer of records. The department of administration shall transfer
10all records of the sentencing commission to the director of state courts as soon as
11possible after the effective date of this subsection.
AB768-ASA1-AA26,3,17 12(3fx) Director of state courts position authorization. The authorized FTE
13positions for the supreme court are increased by 2.0 research analyst positions, 0.5
14computer programmer position and 0.5 clerical position on November 1, 1999, to be
15funded from the appropriation under section 20.680 (2) (a) of the statutes, for
16services on behalf of the director of state courts and to provide property, services and
17supplies for the director of state courts to complete prison impact assessments.".

AB768-ASA1-AA26,4,2 20(1t) Director of state courts. In the schedule under section 20.005 (3) of the
21statutes for the appropriation to the supreme court under section 20.680 (2) (a) of the
22statutes, as affected by the acts of 1997, the dollar amount is increased by $60,000
23for fiscal year 1998-99 to increase the authorized FTE project positions for the
24supreme court by 2.0 computer programmer positions for services and supplies for

1the director of state courts for the period beginning on January 1, 1999, and ending
2on December 31, 1999.".
