TO 1997 ASSEMBLY BILL 768

AB768-SA8,1,21 At the locations indicated, amend the bill, as shown by assembly substitute
2amendment 1, as follows:
AB768-SA8,1,4 31. Page 12, line 16: after "teachers;" insert "creating a professional standards
4council for teachers;".
AB768-SA8,1,5 52. Page 23, line 17: after that line insert:
AB768-SA8,1,6 6" Section 4ra. 15.377 (8) of the statutes is created to read:
AB768-SA8,1,97 15.377 (8) Professional standards council for teachers. (a) Definition. In
8this subsection, "labor organization" means an association of employe organizations
9that represents the public policy, labor and professional interests of teachers.
AB768-SA8,1,1110 (b) Creation. There is created a professional standards council for teachers in
11the department of public instruction.
AB768-SA8,2,3
1(c) Members. The professional standards council for teachers shall consist of
2the following members, nominated by the state superintendent of public instruction
3and with the advice and consent of the senate appointed:
AB768-SA8,2,64 1. Two persons licensed and actively employed as elementary school teachers
5in the public schools, recommended by the largest statewide labor organization
6representing teachers.
AB768-SA8,2,97 2. Two persons licensed and actively employed as middle school, junior high
8school or senior high school teachers in the public schools, recommended by the
9largest statewide labor organization representing teachers.
AB768-SA8,2,1210 3. Two persons licensed and actively employed as pupil services professionals,
11as defined in s. 118.257 (1) (c), in the public schools, recommended by the largest
12statewide labor organization representing teachers.
AB768-SA8,2,1513 4. One person licensed and actively employed as a special education teacher in
14the public schools, recommended by the largest statewide labor organization
15representing teachers.
AB768-SA8,2,1816 5. Two other persons licensed and actively employed as teachers in the public
17schools, recommended by the largest statewide labor organization representing
18teachers.
AB768-SA8,2,2019 5m. One person licensed as a teacher and actively employed in a private school,
20recommended by the Wisconsin Association of Nonpublic Schools.
AB768-SA8,2,2221 6. One person actively employed as a public school district administrator,
22recommended by the Wisconsin Association of School District Administrators.
AB768-SA8,2,2423 7. One person actively employed as a public school principal, recommended by
24the Association of Wisconsin School Administrators.
AB768-SA8,3,3
18. One faculty member of a department or school of education in the University
2of Wisconsin System, recommended by the president of the University of Wisconsin
3System.
AB768-SA8,3,64 9. One faculty member of a department or school of education in a private
5college in Wisconsin, recommended by the Wisconsin Association of Independent
6Colleges and Universities.
AB768-SA8,3,87 10. One additional faculty member, appointed from the list of persons
8recommended under subd. 8. or 9.
AB768-SA8,3,109 11. Two members of public school boards, recommended by the Wisconsin
10Association of School Boards.
AB768-SA8,3,1111 12. One person who is a parent of a child who is enrolled in a public school.
AB768-SA8,3,1312 13. One person who is a student enrolled in a teacher preparatory program,
13located in this state, that leads to initial licensure as a teacher.
AB768-SA8,3,1614 (d) Recommendations. For each vacancy on the council under par. (c) 1. to 9.
15and 11., the entity authorized to recommend a member shall provide the names of
163 qualified persons to the state superintendent of public instruction.
AB768-SA8,3,1817 (e) Terms. Members of the council shall serve 3-year terms except that the
18student appointed under par. (c) 13. shall serve a 2-year term.
AB768-SA8,3,2019 (f) Meetings. The council shall meet on a regular basis and at least twice each
20year.".

AB768-SA8,3,22 22" Section 17s. 17.01 (13) (intro.) of the statutes is amended to read:
AB768-SA8,4,1223 17.01 (13) (intro.) Resignations shall be made in writing, shall be addressed
24and delivered to the officer or body prescribed in this section and shall take effect,

1in the case of an officer who is not a school district officer and whose term of office
2continues by law until a successor is chosen and qualifies, upon the qualification of
3the successor; and in the case of other officers including school district officers, at the
4time indicated in the written resignation, or if no time is therein indicated, then upon
5delivery of the written resignation. If the governor or the state superintendent of
6public instruction
makes a provisional appointment under s. 17.20 (2) and the
7appointee files the required oath of office, the appointee qualifies for office, unless
8the appointment is withdrawn or rejected. Delivery of a resignation shall be made
9by leaving a copy thereof with the officer to whom it is required to be addressed and
10delivered at his or her public office or usual place of business, or if required to be
11addressed and delivered to a body, by leaving a copy with the following officer at his
12or her public office or usual place of business:
AB768-SA8, s. 17t 13Section 17t. 17.20 (2) of the statutes is renumbered 17.20 (2) (a) and amended
14to read:
AB768-SA8,5,215 17.20 (2) (a) Vacancies occurring in the office of any officer normally nominated
16by the governor, and with the advice and consent of the senate appointed, may be
17filled by a provisional appointment by the governor for the residue of the unexpired
18term, if any, subject to confirmation by the senate. Any such appointment shall be
19in full force until acted upon by the senate, and when confirmed by the senate shall
20continue for the residue of the unexpired term, if any, or until a successor is chosen
21and qualifies. A provisional appointee may exercise all of the powers and duties of
22the office to which such person is appointed during the time in which the appointee
23qualifies. Any appointment made under this subsection paragraph which is
24withdrawn or rejected by the senate shall lapse. When a provisional appointment
25lapses, a vacancy occurs. Whenever a new legislature is organized, any

1appointments then pending before the senate shall be referred by the president to
2the appropriate standing committee of the newly organized senate.
AB768-SA8, s. 17u 3Section 17u. 17.20 (2) (b) of the statutes is created to read:
AB768-SA8,5,164 17.20 (2) (b) A vacancy occurring in the membership of the professional
5standards council for teachers may be filled by a provisional appointment by the
6state superintendent of public instruction for the residue of the unexpired term, if
7any, subject to confirmation by the senate. Any such appointment shall be in full
8force until acted upon by the senate, and when confirmed by the senate shall
9continue for the residue of the unexpired term, if any, or until a successor is chosen
10and qualifies. A provisional appointee may exercise all of the powers and duties of
11the office to which the person is appointed during the time in which the appointee
12qualifies. Any appointment made under this paragraph that is withdrawn or
13rejected by the senate shall lapse. When a provisional appointment lapses, a vacancy
14occurs. Whenever a new legislature is organized, any appointments then pending
15before the senate shall be referred by the president to the appropriate standing
16committee of the newly organized senate.
AB768-SA8, s. 17v 17Section 17v. 19.42 (10) (e) of the statutes is amended to read:
AB768-SA8,5,2018 19.42 (10) (e) An individual appointed by the governor or the state

pursuant to s. 17.20 (2) other than a trustee of
20any private higher educational institution receiving state appropriations.".

AB768-SA8,5,24 23115.425 Professional standards council for teachers. The professional
24standards council for teachers shall do all of the following:
AB768-SA8,6,3
1(1) Advise the state superintendent on standards for the licensure of teachers,
2including initial licensure and maintenance and renewal of licenses, to ensure the
3effective teaching of a relevant curriculum in Wisconsin schools.
AB768-SA8,6,5 4(2) Propose to the state superintendent standards for evaluating and
5approving teacher education programs, including continuing education programs.
AB768-SA8,6,7 6(3) Provide to the state superintendent an ongoing assessment of the
7complexities of teaching and the status of the teaching profession in this state.
AB768-SA8,6,9 8(4) Propose to the state superintendent policies and practices for school boards
9and state and local teacher organizations to use in developing effective teaching.
AB768-SA8,6,11 10(5) Propose to the state superintendent standards and procedures for revoking
11a teaching license.
AB768-SA8,6,15 12(6) Propose to the state superintendent ways to recognize excellence in
13teaching, including the assessment administered by the National Board for
14Professional Teaching Standards and master educator licensure, and to assist
15teachers to achieve excellence in teaching.
AB768-SA8,6,18 16(7) Propose to the state superintendent effective peer assistance and peer
17mentoring models, including evaluation systems, and alternative teacher dismissal
18procedures for consideration by school boards and labor organizations.
AB768-SA8,6,21 19(8) Review and make recommendations regarding administrative rules
20proposed by the department that relate to teacher preparation, licensure and
21regulation.
AB768-SA8,6,23 22(9) Propose to the state superintendent alternative procedures for the
23preparation and licensure of teachers.

1(10) Report annually to the standing committees in each house of the
2legislature that deal with education matters on the activities and effectiveness of the
3council.".
