AB876-SA4,1,11 At the locations indicated, amend the bill as follows:
AB876-SA4,1,2 21. Page 1, line 2: after "program" insert ", nursing home forfeitures".
AB876-SA4,1,3 32. Page 2, line 14: after that line insert:
AB876-SA4,1,5 4" Section 3s. 50.04 (5) (a) 5. a. and b. of the statutes, as affected by 1997
5Wisconsin Act .... (Assembly Bill 768), are amended to read:
AB876-SA4,1,96 50.04 (5) (a) 5. a. A nursing home that violates a statute or rule resulting in a
7class "A" violation and that has received a notice of violation for a class "A" violation
8within the previous 3-year period involving the same situation shall be subject to a
9forfeiture 3 times the amount authorized for a class "A" violation.
AB876-SA4,2,210 b. Except as provided in subd. 5. a., a nursing home that violates a statute or
11rule resulting in a class "A" or class "B" violation and that has received a notice of a
12class "A" or class "B" violation of the same statute or rule within the previous 3-year

1period may be subject to a forfeiture 3 times the amount authorized for a the most

class "B" of violation involved.".

AB876-SA4,2,8 4"(2) Reconciliation provision. The treatment of section 50.04 (5) (a) 5. a. and
5b. of the statutes by this act is void unless the treatment of section 50.04 (5) (a) 5. a.
6and b. of the statutes by 1997 Assembly Bill 768, as shown by assembly substitute
7amendment 1, is enacted into law in exactly the same form as it appears in 1997
8Assembly Bill 768, as shown by assembly substitute amendment 1.".
