ASSEMBLY SUBSTITUTE AMENDMENT 1,
TO 1997 ASSEMBLY JOINT RESOLUTION 43

AJR43-ASA1,1,3 1To amend section 4 (1) of article VI; and to create section 4 (6) and (7) of article VI
2of the constitution; relating to: 4-year terms of office for, and qualification to
3hold or seek other offices by, district attorneys (first consideration).
AJR43-ASA1,1,4 4Resolved by the assembly, the senate concurring, That:
AJR43-ASA1, s. 1 5Section 1. Section 4 (1) of article VI of the constitution is amended to read:
AJR43-ASA1,1,96 [Article VI] Section 4 (1) Sheriffs Except as provided in sub. (2), sheriffs,
7coroners, registers of deeds, district attorneys, and all other elected county officers
8except judicial officers, district attorneys and chief executive officers, shall be chosen
9by the electors of the respective counties once in every 2 years.
AJR43-ASA1, s. 2 10Section 2. Section 4 (6) and (7) of article VI of the constitution are created to
11read:
AJR43-ASA1,1,1412 [Article VI] Section 4 (6) Beginning with the first general election which occurs
13following ratification of this subsection, district attorneys shall be chosen by the
14electors of the respective counties once in every 4 years.

1(7) A district attorney shall neither hold nor become a candidate for any other
2partisan office during the term for which he or she is elected or appointed.
AJR43-ASA1, s. 3 3Section 3. Numbering of new provisions. (1) The new subsection (6) of
4section 4 of article VI of the constitution created in this joint resolution shall be
5designated by the next higher open whole subsection number in that section in that
6article if, before the ratification by the people of the amendment proposed in this joint
7resolution, any other ratified amendment has created a subsection (6) of section 4 of
8article VI of the constitution of this state. If one or more joint resolutions create a
9subsection (6) of section 4 of article VI simultaneously with the ratification by the
10people of the amendment proposed in this joint resolution, the subsections created
11shall be numbered and placed in a sequence so that the subsections created by the
12joint resolution having the lowest enrolled joint resolution number have the numbers
13designated in that joint resolution and the subsections created by the other joint
14resolutions have numbers that are in the same ascending order as are the numbers
15of the enrolled joint resolutions creating the subsections.
AJR43-ASA1,3,316 (2) The new subsection (7) of section 4 of article VI of the constitution created
17in this joint resolution shall be designated by the next higher open whole subsection
18number in that section in that article if, before the ratification by the people of the
19amendment proposed in this joint resolution, any other ratified amendment has
20created a subsection (7) of section 4 of article VI of the constitution of this state. If
21one or more joint resolutions create a subsection (7) of section 4 of article VI
22simultaneously with the ratification by the people of the amendment proposed in this
23joint resolution, the subsections created shall be numbered and placed in a sequence
24so that the subsections created by the joint resolution having the lowest enrolled joint
25resolution number have the numbers designated in that joint resolution and the

1subsections created by the other joint resolutions have numbers that are in the same
2ascending order as are the numbers of the enrolled joint resolutions creating the
3subsections.
AJR43-ASA1,3,6 4Be it further resolved, That this proposed amendment be referred to the
5legislature to be chosen at the next general election and that it be published for 3
6months previous to the time of holding such election.
