ASSEMBLY AMENDMENT 2, TO 1997 SENATE BILL 225

SB225-AA2,1,2 At the locations indicated, amend the bill, as shown by senate substitute amendment 1, as follows:

SB225-AA2,1,3 1. Page 3, line 5: after "(4)" insert "and except as provided in sub. (6)".

SB225-AA2,1,4 2. Page 3, line 14: after that line insert:

SB225-AA2,1,5 " Section 10c. 632.38 (6) of the statutes is created to read:

SB225-AA2,1,9 632.38 (6) Choice policy provision. (a) In lieu of the requirement under sub. (5), an insurer may offer an applicant for insurance under a motor vehicle insurance policy that covers the repair of the insured's motor vehicle a choice between the following 2 options:

SB225-AA2,1,12 1. Reserving the right to request that only original manufacturer replacement parts be used in the repair of the insured's motor vehicle if the provisions under sub. (5) (a) and (b) apply at the time of a repair.

SB225-AA2,2,2 2. Authorizing the use of nonoriginal manufacturer replacement parts in the repair of the insured's motor vehicle.

SB225-AA2,2,6 (b) An insurer is not required to offer an applicant for insurance the choice under this subsection more than one time. The absence of a premium payment with respect to a coverage option under par. (a) 1. or 2. is conclusive proof that the person has rejected the coverage option.

SB225-AA2, s. 10m Section 10m. 632.38 (6) of the statutes, as created by 1997 Wisconsin Act .... (this act), is repealed.".

SB225-AA2,2,9 3. Page 3, line 25: delete "and (5)" and substitute ", (5) and (6)".

SB225-AA2,2,10 4. Page 4, line 3: on lines 3 and 9, delete "and (5)" and substitute ", (5) and (6)".
