TO 1997 SENATE BILL 23

SB23-SSA1,1,8 1An Act to amend 341.14 (6r) (b) 1., 341.14 (6r) (b) 3., 341.14 (6r) (c) and 341.14
2(6r) (e); to repeal and recreate 341.14 (6r) (c) and 341.14 (6r) (e); and to create
316.25, 20.395 (5) (cj), 20.455 (2) (jp), 20.505 (3) (j), 25.40 (1) (a) 13., 165.86 (3),
4341.14 (6r) (b) 6., 341.14 (6r) (f) 53. and 341.14 (6r) (h) of the statutes; relating
5to:
special distinguishing registration plates associated with the Green Bay
6Packers professional football team, payments to D.A.R.E. Wisconsin, Ltd., Boys
7and Girls Clubs of America and the Children's Hospital of Wisconsin, Inc., and
8making appropriations.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB23-SSA1, s. 1 9Section 1. 16.25 of the statutes is created to read:
SB23-SSA1,2,2 1016.25 Contributions from proceeds of special license plates. The
11secretary of administration shall make payments in equal amounts from the

1appropriation under s. 20.505 (3) (j) to the Boys and Girls Club of America and to the
2Children's Hospitals of Wisconsin, Inc.
SB23-SSA1, s. 2 3Section 2. 20.395 (5) (cj) of the statutes is created to read:
SB23-SSA1,2,64 20.395 (5) (cj) Licensing fees, state funds. From the general fund, all moneys
5received under s. 341.14 (6r) (b) 6. a. for the purpose of making payments of licensing
6fees under s. 341.14 (6r) (h).
SB23-SSA1, s. 3 7Section 3. 20.455 (2) (jp) of the statutes is created to read:
SB23-SSA1,2,108 20.455 (2) (jp) D.A.R.E. Wisconsin, Ltd., payments. All moneys received under
9s. 341.14 (6r) (b) 6. b. 1. for payments to D.A.R.E. Wisconsin, Ltd., under s. 165.86
10(3) (a).
SB23-SSA1, s. 4 11Section 4. 20.505 (3) (j) of the statutes is created to read:
SB23-SSA1,2,1412 20.505 (3) (j) Contributions to charitable organizations. All moneys received
13under s. 341.14 (6r) (b) 6. b. 2. for payments to Boys and Girls Clubs of America and
14to the Children's Hospital of Wisconsin, Inc. under s. 16.25.
SB23-SSA1, s. 5 15Section 5. 25.40 (1) (a) 13. of the statutes is created to read:
SB23-SSA1,2,1816 25.40 (1) (a) 13. Moneys received under s. 341.14 (6r) (b) 6. that are deposited
17in the general fund and credited to the appropriations under ss. 20.395 (5) (cj), 20.455
18(2) (jp) and 20.505 (3) (j).
SB23-SSA1, s. 6 19Section 6. 165.86 (3) of the statutes is created to read:
SB23-SSA1,2,2220 165.86 (3) (a) Enter into an agreement with D.A.R.E. Wisconsin, Ltd., to make
21payments from the appropriation under s. 20.455 (2) (jp) to D.A.R.E. Wisconsin, Ltd.,
22to fund any of the following:
SB23-SSA1,3,223 1. Programs and activities relating to drug abuse resistance education,
24including law enforcement training to implement drug abuse resistance education

1programs in this state and to conduct public educational activities consistent with
2the purposes of D.A.R.E. Wisconsin, Ltd.
SB23-SSA1,3,53 2. Reasonable costs relating to marketing of the special group plate under s.
4341.14 (6r) (f) 53. D.A.R.E. Wisconsin, Ltd., may enter into a marketing agreement
5with any person to provide the services under this subdivision.
SB23-SSA1,3,96 (b) The agreement under par. (a) shall require that D.A.R.E. Wisconsin, Ltd.,
7annually submit to the attorney general and the presiding officer of each house of the
8legislature an audited financial statement of its use of the payments under par. (a),
9prepared in accordance with generally accepted accounting principles.
SB23-SSA1,3,1210 (c) Payments to D.A.R.E. Wisconsin, Ltd., under par. (a) shall be discontinued
11by the department if D.A.R.E. Wisconsin, Ltd., dissolves or is no longer exempt from
12taxation under section 501 (c) of the Internal Revenue Code.
SB23-SSA1, s. 7 13Section 7. 341.14 (6r) (b) 1. of the statutes is amended to read:
SB23-SSA1,3,2514 341.14 (6r) (b) 1. Upon application to register an automobile, station wagon or
15motor home, or a motor truck, dual purpose motor home or dual purpose farm truck
16which has a gross weight of not more than 8,000 pounds, or a farm truck which has
17a gross weight of not more than 12,000 pounds, by any person who is a resident of
18this state and a member of an authorized special group, the department shall issue
19to the person special plates whose colors and design shall indicate that the vehicle
20is owned by a person who is a member of the applicable special group. The
21department may not issue any special group plates under par. (f) 53. until 6 months
22after the department has received information sufficient for the department to
23determine that any approvals required for use of any logo, trademark, trade name
24or other commercial symbol designating the professional football team have been
25obtained.

1Section 8. 341.14 (6r) (b) 3. of the statutes is amended to read:
SB23-SSA1,4,82 341.14 (6r) (b) 3. An additional fee of $15 shall be charged for the issuance or
3reissuance of a plate issued on an annual basis for a special group specified under
4par. (f) 35. to 47. or 53. An additional fee of $15 shall be charged for the issuance or
5reissuance of a plate issued on a biennial basis for a special group specified under par.
6(f) 35. to 47. or 53. if the plate is issued during the first year of the biennial
7registration period or $15 for the issuance or reissuance if the plate is issued during
8the 2nd year of the biennial registration period.
SB23-SSA1, s. 9 9Section 9. 341.14 (6r) (b) 6. of the statutes is created to read:
SB23-SSA1,4,2110 341.14 (6r) (b) 6. An additional fee of $25 that is in addition to the fee under
11subd. 3. shall be charged for the issuance or renewal of a plate issued on an annual
12basis for the special group specified under par. (f) 53. An additional fee of $50 that
13is in addition to the fee under subd. 3. shall be charged for the issuance or renewal
14of a plate issued on the biennial basis for the special group specified under par. (f) 53.
15if the plate is issued or renewed during the first year of the biennial registration
16period or $25 for the issuance or renewal if the plate is issued or renewed during the
172nd year of the biennial registration period. To the extent permitted under ch. 71,
18the fee under this subdivision is deductible as a charitable contribution for purposes
19of the taxes under ch. 71. All moneys received under this subdivision in excess of the
20initial costs of data processing for the special group plate under par. (f) 53. or $35,000,
21whichever is less, shall be deposited in the general fund and credited as follows:
SB23-SSA1,4,2322 a. An amount equal to the costs of licensing fees under par. (h) shall be credited
23to the appropriation account under s. 20.395 (5) (cj).
SB23-SSA1,4,2524 b. 1. One-third of the remainder after crediting the appropriation as provided
25in subd. 6. a. shall be credited to the appropriation account under s. 20.455 (2) (jp).

12. Two-thirds of the remainder after crediting the appropriation as provided
2in subd. 6. a. shall be credited to the appropriation account under s. 20.505 (3) (j).
SB23-SSA1, s. 10 3Section 10. 341.14 (6r) (c) of the statutes is amended to read:
SB23-SSA1,5,174 341.14 (6r) (c) Special group plates shall display the word "Wisconsin", the
5name of the applicable authorized special group, a symbol representing the special
6group, not exceeding one position, and identifying letters or numbers or both, not
7exceeding 6 positions and not less than one position. The department shall specify
8the design for special group plates, but the department shall consult the president
9of the University of Wisconsin system before specifying the design for the special
10group plates under par. (f) 35. to 47., the Wisconsin sesquicentennial commission
11before specifying the design for the special group plate under par. (f) 52. and, the
12secretary of natural resources before specifying the design for the special group plate
13under par. (f) 50. and the chief executive officer of the Green Bay Packers professional
14football team and an authorized representative of the National Football League
15before specifying the design for the applicable special group plate under par. (f) 53.

16Special group plates under par. (f) 50. shall be as similar as possible to regular
17registration plates in color and design.
SB23-SSA1, s. 11 18Section 11. 341.14 (6r) (c) of the statutes, as affected by 1995 Wisconsin Act

and 1997 Wisconsin Act .... (this act), is repealed and recreated to read:
SB23-SSA1,6,720 341.14 (6r) (c) Special group plates shall display the word "Wisconsin", the
21name of the applicable authorized special group, a symbol representing the special
22group, not exceeding one position, and identifying letters or numbers or both, not
23exceeding 6 positions and not less than one position. The department shall specify
24the design for special group plates, but the department shall consult the president
25of the University of Wisconsin System before specifying the design for the special

1group plates under par. (f) 35. to 47., the secretary of natural resources before
2specifying the design for the special group plate under par. (f) 50. and the chief
3executive officer of the Green Bay Packers professional football team and an
4authorized representative of the National Football League before specifying the
5design for the applicable special group plate under par. (f) 53. Special group plates
6under par. (f) 50. shall be as similar as possible to regular registration plates in color
7and design.
SB23-SSA1, s. 12 8Section 12. 341.14 (6r) (e) of the statutes is amended to read:
SB23-SSA1,7,119 341.14 (6r) (e) The department shall specify one combination of colors for
10special group plates for groups or organizations which are not military in nature and
11not special group plates under par. (f) 35. to 47., 50. and 52. The department, after
12consulting the president of the University of Wisconsin system, shall specify one
13combination of colors for special group plates under par. (f) 35. to 47. The department
14shall specify the word or words comprising the special group name and the symbol
15to be displayed upon special group plates for a group or organization which is not
16military in nature after consultation with the chief executive officer in this state of
17the group or organization, except that the department may not specify the word or
18words or the symbol for special group plates under par. (f) 35. to 47. unless the word
19or words or symbol is approved in writing by the president of the university of
20Wisconsin system or, with respect to endangered resources, specify the word or words
21or the symbol for special group plates under par. (f) 50. unless the word or words or
22symbol is approved in writing by the secretary of natural resources or, with respect
23to the special group plate under par. (f) 53., specify the word or words or the symbol
24for the group unless the word or words or the symbol is approved in writing by the
25chief executive officer of the Green Bay Packers professional football team and an

1authorized representative of the National Football League
or, with respect to
2commemorating the 150th anniversary of Wisconsin statehood, specify the word or
3words or the symbol for special group plate under par. (f) 52. unless the word or words
4or symbol is approved in writing by the Wisconsin sesquicentennial commission. The
5president may not approve the word or words or symbol for a university specified
6under par. (f) 35. to 47. unless the chancellor of the university approves in writing
7the word or words or symbol. The department shall require that the word or words
8and symbol for a university specified under par. (f) 35. to 47. be a registration decal
9or tag and affixed to the special group plate and be of the colors for a university
10specified under par. (f) 35. to 47. that the president of the university of Wisconsin
11system specifies.

and 1997 Wisconsin Act .... (this act), is repealed and recreated to read:

10university specified under par. (f) 35. to 47. be a registration decal or tag and affixed
11to the special group plate and be of the colors for a university specified under par. (f)
1235. to 47. that the president of the university of Wisconsin system specifies.
SB23-SSA1, s. 14 13Section 14. 341.14 (6r) (f) 53. of the statutes is created to read:
SB23-SSA1,8,1514 341.14 (6r) (f) 53. Persons interested in expressing their support of the Green
15Bay Packers professional football team.
SB23-SSA1, s. 15 16Section 15. 341.14 (6r) (h) of the statutes is created to read:
SB23-SSA1,8,1917 341.14 (6r) (h) From the appropriation under s. 20.395 (5) (cj), the department
18shall pay reasonable licensing fees relating to the word or words or the symbol on
19special group plates under par. (f) 53.
SB23-SSA1, s. 16 20Section 16. Effective dates. This act takes effect on the first day of the 5th
21month beginning after publication, except as follows:
SB23-SSA1,8,2322 (1) The repeal and recreation of section 341.14 (6r) (c) and (e) of the statutes
23takes effect on January 1, 1999.
