SENATE AMENDMENT 1, TO 1997 SENATE BILL 389

SB389-SA1,1,1 At the locations indicated, amend the bill as follows:

SB389-SA1,1,5 1. Page 1, line 3: delete "for dental plans from certain mandated coverages" and substitute "from certain mandated coverages for dental plans and policies covering only specified diseases and providing a maximum required coverage amount for certain nonsurgical procedures".

SB389-SA1,1,6 2. Page 2, line 8: after that line insert:

SB389-SA1,1,8 " Section 1c. 632.895 (11) (c) of the statutes, as created by 1997 Wisconsin Act 27, is renumbered 632.895 (11) (c) 1. and amended to read:

SB389-SA1,1,12 632.895 (11) (c) 1. The Except as provided in subd. 2., the coverage required under this subsection may be subject to any limitations, exclusions or cost-sharing provisions that apply generally under the disability insurance policy or self-insured health plan.

SB389-SA1, s. 1m Section 1m. 632.895 (11) (c) 2. of the statutes is created to read:

SB389-SA1,2,6 632.895 (11) (c) 2. The coverage required under this subsection for diagnostic procedures and medically necessary nonsurgical treatment, including related medical services and supplies, need not exceed, for an individual in a coverage year, $3,000, or the equivalent benefits measured in services rendered and supplies provided if the coverage is provided by a health maintenance organization, as defined in s. 609.01 (2).".

SB389-SA1,2,7 3. Page 2, line 10: delete lines 10 and 11 and substitute:

SB389-SA1,2,8 "632.895 (11) (d) This subsection does not apply to any of the following:

SB389-SA1,2,9 1. A disability insurance policy that covers only dental care.

SB389-SA1,2,10 2. A disability insurance policy that covers only certain specified diseases.".

SB389-SA1,2,11 4. Page 2, line 21: delete lines 21 and 22 and substitute:

SB389-SA1,2,12 "632.895 (12) (d) This subsection does not apply to any of the following:

SB389-SA1,2,13 1. A disability insurance policy that covers only dental care.

SB389-SA1,2,14 2. A disability insurance policy that covers only certain specified diseases.".

SB389-SA1,2,15 5. Page 2, line 24: delete that line and substitute:

SB389-SA1,2,17 "(1m) The treatment of section 632.895 (11) (a) (intro.) and (d) and (12) (b) (intro.) and (d) of the statutes first applies to all of the following:".

SB389-SA1,2,19 6. Page 3, line 2: on lines 2 and 4, after "dental care" insert "or only certain specified diseases".

SB389-SA1,2,20 7. Page 3, line 10: after that line insert:

SB389-SA1,2,23 "(2) The renumbering and amendment of section 632.895 (11) (c) of the statutes and the creation of section 632.895 (11) (c) 2. of the statutes first apply to all of the following:

SB389-SA1,3,3 (a) Except as provided in paragraphs (b) and (c), disability insurance policies that are issued or renewed, and self-insured health plans that are established, extended, modified or renewed, on the effective date of this paragraph.

SB389-SA1,3,6 (b) Disability insurance policies covering employes who are affected by a collective bargaining agreement containing provisions inconsistent with this act that are issued or renewed on the earlier of the following:

SB389-SA1,3,7 1. The day on which the collective bargaining agreement expires.

SB389-SA1,3,9 2. The day on which the collective bargaining agreement is extended, modified or renewed.

SB389-SA1,3,12 (c) Self-insured health plans covering employes who are affected by a collective bargaining agreement containing provisions inconsistent with this act that are established, extended, modified or renewed on the earlier of the following:

SB389-SA1,3,13 1. The day on which the collective bargaining agreement expires.

SB389-SA1,3,15 2. The day on which the collective bargaining agreement is extended, modified or renewed.".
