1An Act to amend 11.33 (title) and (1) (a) and 11.33 (1) (b); and
to create 11.33
2(1) (a) 5. of the statutes;
relating to: use of public funds by certain state and
3local officials for production or distribution of certain materials.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1. 11.33 (title) and (1) (a) of the statutes are amended to read:

Use of government materials by candidates public officers.

6(1) (a) No person
who is elected to state or local office
who becomes a candidate
7for national, state or local office may use public funds for the cost of materials or
8distribution for 50 or more pieces of substantially identical material distributed after
9the earlier of the following dates:

1. In the case of
a person who becomes a candidate
who is nominated for a
11national, state or local office for which nomination is by nomination papers, the first
1day authorized by law for circulation of nomination papers as a candidate
for that
2office.

2. In the case of
a person who becomes a candidate
for a national, state or local
4office and who is nominated
for that office at a primary election by write-in votes,
5the day the board of canvassers issues its determination that the person is
6nominated.

3. In the case of
a person who becomes a candidate
for a national, state or local
8office and who is nominated
for that office at a caucus, the date of the caucus.

4. In the case of
any other a person who becomes a candidate
for any national,
10state or local office and who is nominated
for that office solely by filing a declaration
11of candidacy, the first day of the month preceding the month which includes the last
12day for filing the declaration.

2. 11.33 (1) (a) 5. of the statutes is created to read:

(1) (a) 5. In the case of a person who is not a candidate for a national, state
15or local office, the first day of the month preceding the month which includes the last
16day for filing a declaration of candidacy to succeed that person in office.

(1) (b) This subsection applies until after the date of the election
or after
19the date of the primary election if the person appears as a candidate on a primary
20election ballot and is not nominated at the primary election at which successor to the
21incumbent officer is elected.
